       Introduced by M. of A. ALESSI -- read once and referred to the Committee
         on Consumer Affairs and Protection
       AN  ACT  to  amend  the  county law, in relation to requiring the county
         clerk to notify consumer credit reporting agencies of  any  withdrawal
         notices  or  any other changes which may affect an individual's credit
         rating; and the general business law, in relation to requiring consum-
         er credit reporting agencies to remove  erroneous  information  within
         thirty days of notice and proof
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 525 of the county law is amended by  adding  a  new
    2  subdivision 3 to read as follows:
    3    3.  HE  SHALL IMMEDIATELY NOTIFY ANY CONSUMER CREDIT REPORTING AGENCY,
    4  AS DEFINED BY SUBDIVISION (K) OF SECTION THREE HUNDRED EIGHTY-A  OF  THE
    5  GENERAL  BUSINESS  LAW,  WHICH  HE  HAS FURNISHED INFORMATION TO, OF ANY
    6  CHANGES INCLUDING A WITHDRAWAL NOTICE IF ONE  HAS  BEEN  FILED,  OR  ANY
    7  OTHER  DOCUMENTS WHICH HAVE BEEN FILED WHICH MAY INDICATE A CHANGE IN AN
    8  INDIVIDUAL CREDIT RATING.
    9    S 2. Section 380-g of the general business law is amended by adding  a
   10  new subdivision (c-1) to read as follows:
   11    (C-1) EXTRUDE ANY ERRONEOUS INFORMATION WITHIN THIRTY DAYS UPON NOTICE
   12  AND  PROOF  THAT  SUCH  INFORMATION IS ERRONEOUS AND MAKE ANY APPLICABLE
   13  UPDATES AT SUCH TIME.
   14    S 3. This act shall take effect immediately.
