       AN  ACT  to  amend  the  executive law, in relation to fees collected by
         title companies and their agents
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Section  96-a of the executive law is amended by adding a
    2  new subdivision 4 to read as follows:
    3    4. ANY FEE COLLECTED BY A TITLE COMPANY OR ITS AGENT ON  BEHALF  OF  A
    4  PARTY  FOR  PAYMENT TO THE SECRETARY OF STATE OR OTHER OFFICE SHALL BE A
    5  NON-REFUNDABLE FEE WHETHER OR NOT THE DOCUMENTS FOR WHICH  SUCH  FEE  IS
    6  COLLECTED  ARE ACCEPTED FOR FILING BY SUCH SECRETARY OR OFFICE. SUCH FEE
    7  SHALL BE RETAINED BY SUCH TITLE COMPANY OR AGENT AS A FEE  FOR  SERVICES
    8  RENDERED.  SUCH  FEE SHALL NOT BE APPLIED TO THE PAYMENT OF FEES FOR THE
    9  FILING OF ANY DOCUMENTS AT A SUBSEQUENT TIME.
   10    S 2. This act shall take effect on the sixtieth  day  after  it  shall
   11  have become a law.
