RABBITT -- read once and referred to the Commit- tee on Transportation AN ACT to amend the vehicle and traffic law, in relation to the issuance of distinctive plates for veterans of the Iraq and Afghanistan conflicts THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The vehicle and traffic law is amended by adding a new 2 section 404-x to read as follows: 3 S 404-X. DISTINCTIVE PLATES FOR VETERANS OF THE IRAQ AND AFGHANISTAN 4 CONFLICTS. 1. ANY IRAQ AND AFGHANISTAN CONFLICT VETERAN OR THE SPOUSE OF 5 ANY SUCH VETERAN SHALL, UPON REQUEST, BE ISSUED A LICENSE PLATE BEARING 6 THE WORDS "IRAQ AND AFGHANISTAN CONFLICT VETERAN". IF A DISTINCTIVE 7 PLATE IS ISSUED TO A VETERAN PURSUANT TO THIS SECTION, SUCH A DISTINC- 8 TIVE PLATE SHALL NOT BE ISSUED TO THE SPOUSE OF SUCH VETERAN. APPLICA- 9 TION FOR SUCH LICENSE PLATE SHALL BE FILED WITH THE COMMISSIONER IN SUCH 10 FORM AND DETAIL AS THE COMMISSIONER SHALL PRESCRIBE. 11 2. THE DISTINCTIVE PLATE AUTHORIZED IN SUBDIVISION ONE OF THIS SECTION 12 SHALL BE ISSUED UPON PROOF, SATISFACTORY TO THE COMMISSIONER, THAT THE 13 APPLICANT OR THE SPOUSE OF THE APPLICANT IS AN IRAQ AND AFGHANISTAN 14 CONFLICT VETERAN. 15 3. FOR THE PURPOSES OF THIS SECTION, "IRAQ AND AFGHANISTAN CONFLICT 16 VETERAN" SHALL MEAN A PERSON WHO IS A RESIDENT OF THIS STATE, WHO SERVED 17 IN THE ARMED FORCES OF THE UNITED STATES IN THE HOSTILITIES THAT 18 OCCURRED IN IRAQ COMMENCING ON THE NINETEENTH DAY OF MARCH, TWO THOUSAND 19 THREE AND IN AFGHANISTAN COMMENCING THE SEVENTH DAY OF OCTOBER IN TWO 20 THOUSAND ONE, AND WERE HONORABLY DISCHARGED FROM THE MILITARY. 21 4. A DISTINCTIVE PLATE ISSUED PURSUANT TO THIS SECTION SHALL BE ISSUED 22 IN THE SAME MANNER AS OTHER NUMBER PLATES UPON PAYMENT OF THE REGULAR 23 REGISTRATION FEE PRESCRIBED BY SECTION FOUR HUNDRED ONE OF THIS ARTICLE 24 PROVIDED, HOWEVER, THAT AN ADDITIONAL ONE TIME SERVICE CHARGE OF TEN EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD10635-01-1 A. 6940 2 1 DOLLARS SHALL BE CHARGED FOR SUCH PLATE. SUCH ANNUAL SERVICE CHARGE 2 SHALL BE DEPOSITED PURSUANT TO THE PROVISIONS OF SECTION FOUR HUNDRED 3 FOUR-OO OF THIS ARTICLE TO THE CREDIT OF THE DEPARTMENT OF MOTOR VEHI- 4 CLES DISTINCTIVE PLATE DEVELOPMENT FUND ESTABLISHED BY SECTION 5 NINETY-FIVE-G OF THE STATE FINANCE LAW AND SHALL BE USED FOR THE 6 PRODUCTION, DESIGN, ADVERTISING AND MARKETING OF DISTINCTIVE LICENSE 7 PLATES PURSUANT TO SUCH SECTION NINETY-FIVE-G. 8 5. NOTHING CONTAINED HEREIN SHALL REQUIRE THE ISSUANCE OF A SPECIAL 9 NUMBER PLATE UNDER THIS SECTION UNLESS THE COMMISSIONER IS SATISFIED 10 THAT THE AGGREGATE AMOUNT OF ANNUAL SERVICE CHARGES COLLECTED PURSUANT 11 TO SUBDIVISION FOUR OF THIS SECTION WILL BE SUFFICIENT TO RECOVER THE 12 COSTS OF THE DESIGN AND MANUFACTURE OF SUCH SPECIAL PLATES. 13 S 2. This act shall take effect on the first of April next succeeding 14 the date on which it shall have become a law.
