RABBITT -- read once and referred to the Commit- tee on Education AN ACT to amend the education law, in relation to school districts providing transportation services to certain pupils to nonpublic schools located within fifteen miles of such school district's bounda- ries THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subparagraph (i) of paragraph b of subdivision 1 of section 2 3635 of the education law, as amended by chapter 571 of the laws of 3 1994, is amended to read as follows: 4 (i) School districts [providing] SHALL PROVIDE transportation FOR 5 PUPILS LIVING WITHIN THE SCHOOL DISTRICT'S BOUNDARIES to a nonpublic 6 school [for pupils living within a specified distance from such] LOCATED 7 WITHIN FIFTEEN MILES OF SUCH SCHOOL DISTRICT'S BOUNDARIES. SUCH school 8 shall designate one or more public schools as centralized pick-up points 9 and shall provide transportation between such points and such nonpublic 10 schools for students residing in the district [who live too far from 11 such nonpublic schools to qualify for transportation between home and 12 school]. The district shall not be responsible for the provision of 13 transportation for pupils between their home and such pick-up points. 14 The district may provide school bus transportation to a pupil if the 15 residence of the pupil is located on an established route for the trans- 16 portation of pupils to the centralized pick-up point provided such 17 transportation does not result in additional costs to the district. The 18 cost of providing transportation between such pick-up points and such 19 nonpublic schools shall be an ordinary contingent expense. 20 S 2. This act shall take effect immediately.
