AN ACT to amend the agriculture and markets law, in relation to granting
the department of agriculture and markets the sole authority to regu-
late cervid farms
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
1 Section 1. Section 16 of the agriculture and markets law is amended by
2 adding a new subdivision 47 to read as follows:
3 47. NOTWITHSTANDING ANY PROVISION OF ARTICLE ELEVEN OF THE ENVIRON-
4 MENTAL CONSERVATION LAW, REGULATE AND OVERSEE ALL CERVID FARMS IN THE
5 STATE. THE AUTHORITY GRANTED PURSUANT TO THIS SUBDIVISION SHALL BE
6 DEEMED TO GRANT THE DEPARTMENT EXCLUSIVE AUTHORITY OVER CERVID FARMING.
7 WITH REGARD THERETO THE PROVISIONS OF THIS CHAPTER AND THE RULES AND
8 REGULATIONS PROMULGATED PURSUANT THERETO, SHALL SUPERSEDE THE PROVISIONS
9 OF THE ENVIRONMENTAL CONSERVATION LAW AND ITS IMPLEMENTING RULES AND
10 REGULATIONS.
11 S 2. This act shall take effect immediately.
