       AN  ACT  to  amend  the public health law, in relation to establishing a
         task force on women's health care and managed care and  providing  for
         the repeal of such provisions upon expiration thereof
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The public health law is amended by adding  a  new  section
    2  4406-f to read as follows:
    3    S  4406-F.  TASK  FORCE  ON  WOMEN'S  HEALTH CARE AND MANAGED CARE. 1.
    4  THERE IS HEREBY CREATED WITHIN THE DEPARTMENT A TASK  FORCE  ON  WOMEN'S
    5  HEALTH  CARE  AND MANAGED CARE. THE TASK FORCE SHALL CONSIST OF THIRTEEN
    6  MEMBERS TO BE APPOINTED AS FOLLOWS: SEVEN MEMBERS TO BE APPOINTED BY THE
    7  GOVERNOR, INCLUDING ONE  REPRESENTATIVE  EACH  FROM  THE  DEPARTMENT  OF
    8  HEALTH,  THE  OFFICE  OF MENTAL HEALTH AND THE INSURANCE DEPARTMENT; TWO
    9  MEMBERS TO BE APPOINTED BY THE SPEAKER OF THE ASSEMBLY; ONE MEMBER TO BE
   10  APPOINTED BY THE MINORITY LEADER OF THE  ASSEMBLY;  TWO  MEMBERS  TO  BE
   11  APPOINTED  BY THE TEMPORARY PRESIDENT OF THE SENATE AND ONE MEMBER TO BE
   12  APPOINTED BY THE MINORITY LEADER OF THE SENATE.   THE  MEMBER  FROM  THE
   13  DEPARTMENT  OF  HEALTH SHALL SERVE AS THE DIRECTOR OF THE TASK FORCE AND
   14  THE COMMISSIONER OF HEALTH MAY ASSIGN SUCH PERSONNEL WITHIN THE  AMOUNTS
   15  APPROPRIATED  AS  IS  NECESSARY  TO  CARRY  OUT  THE  PROVISIONS OF THIS
   16  SECTION.
   17    2. THE TASK FORCE SHALL STUDY  AND  EVALUATE  THE  EXISTING  STATE  OF
   18  WOMEN'S  HEALTH  CARE AND HOW SUCH CARE IS AFFECTED BY MANAGED CARE.  IN
   19  CONDUCTING THIS STUDY THE TASK  FORCE  SHALL  UTILIZE  THE  DEPARTMENT'S
   20  BUREAU OF WOMEN'S HEALTH AND THE OFFICE OF MANAGED CARE FOR THE PURPOSES
   21  OF  GATHERING INFORMATION REGARDING THE TASK FORCE'S DUTIES AS SET FORTH
   22  IN THIS SECTION.
   23    3. ON AN ANNUAL BASIS, ON OR BEFORE JULY FIRST OF EACH YEAR, THE  TASK
   24  FORCE  SHALL PREPARE AND SUBMIT TO THE GOVERNOR, THE TEMPORARY PRESIDENT

    1  OF THE SENATE, THE SPEAKER OF THE ASSEMBLY, THE MINORITY LEADER  OF  THE
    2  ASSEMBLY  AND  THE  MINORITY  LEADER  OF THE SENATE A REPORT WHICH SHALL
    3  INCLUDE, BUT NOT BE LIMITED TO:
    4    (A)  INFORMATION PERTAINING TO ANY DEFICIENCIES IN WOMEN'S HEALTH CARE
    5  AND WHETHER SUCH DEFICIENCIES ARE EXACERBATED BY MANAGED CARE;
    6    (B) RECOMMENDATIONS REGARDING HOW WOMEN'S HEALTH CARE CAN BE  IMPROVED
    7  BOTH GENERALLY AND SPECIFICALLY WITH REGARD TO MANAGED CARE; AND
    8    (C) INFORMATION RELATIVE TO RESOURCES EXPENDED FOR WOMEN'S HEALTH CARE
    9  IN  MANAGED  CARE IN COMPARISON WITH RESOURCES EXPENDED FOR MEN'S HEALTH
   10  CARE IN MANAGED CARE.
   11    S 2. This act shall take effect immediately and shall  expire  and  be
   12  deemed repealed September 1, 2012.
