WILLIAMS -- read once and referred to the Commit- tee on Consumer Affairs and Protection -- recommitted to the Committee on Consumer Affairs and Protection in accordance with Assembly Rule 3, sec. 2 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the general business law, in relation to requiring the disclosure of prices and additional charges at appearance enhancement businesses which practice nail specialty The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 404-b of the general business law, as amended by 2 chapter 80 of the laws of 2015, is amended to read as follows: 3 § 404-b. Nail specialty; owner responsibilities. 1. In addition to any 4 rules and regulations establishing standards for practices and oper- 5 ations by licensees under this article, in order to ensure the health, 6 safety and welfare within appearance enhancement businesses, all owners 7 and operators of appearance enhancement businesses which practice nail 8 specialty shall make available for use, gloves and facemasks for nail 9 [speciality] specialty licensees and trainees who work in such busi- 10 nesses. 11 2. All owners and operators of appearance enhancement businesses which 12 practice nail specialty shall: (a) post a list conspicuously displaying 13 the current price of the services provided. Such price list shall also 14 disclose factors which may cause the price to be higher than the posted 15 price, and the range of the possible additional charges; and (b) ensure 16 all licensees and trainees who work in such businesses inform customers 17 of any additional charges before performing services which incur such 18 additional charges. 19 3. Any violation of this section shall be punishable by a civil penal- 20 ty of two hundred fifty dollars for each violation. 21 § 2.
