STATE OF NEW YORK ________________________________________________________________________ 6551 2019-2020 Regular Sessions IN ASSEMBLY March 11, 2019 ___________ Introduced by M. of A. FINCH -- read once and referred to the Committee on Governmental Operations AN ACT to amend the public officers law, in relation to the qualifica- tions for holding the office of assistant district attorney or senior district attorney in the county of Cayuga The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 3 of the public officers law is amended by adding a 2 new subdivision 68 to read as follows: 3 68. In the county of Cayuga, the provisions of this section requiring 4 a person to be a resident of the political subdivision or municipal 5 corporation of the state for which he or she shall be chosen or within 6 which his or her official functions are required to be exercised, shall 7 not prevent a person from holding the office of assistant district 8 attorney or senior assistant district attorney of the county of Cayuga, 9 provided that such person resides in Cayuga county or an adjoining coun- 10 ty within the state of New York; provided, however, that any person 11 performing such functions or holding the office of assistant district 12 attorney in any other county shall be a resident of such county unless 13 otherwise provided by law. The provisions of this subdivision shall not 14 apply to any person holding the office of chief assistant district 15 attorney, the holder of which would assume the duties of the district 16 attorney upon the district attorney's absence from the county or upon 17 the district attorney's inability to perform his or her duties. 18 § 2.
