       AN ACT to amend the education law,  in  relation  to  providing  aid  to
         school  districts for expenses related to the school districts' use of
         electricity, propane, natural gas, and/or heating oil for  the  school
         year
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 3602 of the education law is amended  by  adding  a
    2  new subdivision 27 to read as follows:
    3    27.  AID FOR ELECTRICITY, PROPANE, NATURAL GAS, AND/OR HEATING OIL FOR
    4  THE SCHOOL YEAR. A. COMMENCING WITH AID  PAYABLE  IN  THE  TWO  THOUSAND
    5  TEN--TWO THOUSAND ELEVEN SCHOOL YEAR, THE COMMISSIONER IS HEREBY AUTHOR-
    6  IZED  TO  APPORTION TO ANY SCHOOL DISTRICT AID PURSUANT TO THIS SUBDIVI-
    7  SION FOR ITS APPROVED EXPENDITURES, IN EXCESS OF BASE YEAR AID RECEIVED,
    8  FOR EXPENSES RELATED TO THE COST OF ELECTRICITY, PROPANE,  NATURAL  GAS,
    9  AND/OR HEATING OIL FOR THE SCHOOL YEAR.
   10    B. AID PURSUANT TO THIS SUBDIVISION SHALL EQUAL TWENTY-FIVE PERCENT OF
   11  THE  SCHOOL DISTRICTS' COST FOR ITS USE OF ELECTRICITY, PROPANE, NATURAL
   12  GAS, AND/OR HEATING OIL THROUGHOUT THE SCHOOL YEAR.
   13    S 2. This act shall take effect immediately.
