       AN ACT to amend the New York state urban development corporation act, in
         relation to compliance with certain provisions of the  New  York  city
         charter
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1.  Subdivision 7 of section 5 of section 1 of chapter 174  of
    2  the  laws  of  1968,  constituting  the New York state urban development
    3  corporation act, is amended to read as follows:
    4    (7)  To acquire or contract to acquire from any person,  firm,  corpo-
    5  ration,  municipality,  federal  or  state  agency,  by grant, purchase,
    6  condemnation or otherwise, leaseholds, real, personal or mixed  property
    7  or  any interest therein; to own, hold, clear, improve and rehabilitate,
    8  and to sell, assign, exchange, transfer,  convey,  lease,  mortgage,  or
    9  otherwise  dispose  of or encumber the same.  NOTWITHSTANDING ANY LAW TO
   10  THE CONTRARY, ANY OF THE ABOVE ACTIONS INVOLVING REAL PROPERTY, SITUATED
   11  IN THE CITY OF NEW YORK, SHALL BE SUBJECT TO SECTION ONE  HUNDRED  NINE-
   12  TY-SEVEN-C OF THE NEW YORK CITY CHARTER RELATING TO THE UNIFORM LAND USE
   13  REVIEW PROCEDURE;
   14    S  2.  Section  13  of  section  1 of chapter 174 of the laws of 1968,
   15  constituting the New York state urban development  corporation  act,  as
   16  amended  by  chapter  840  of  the  laws  of 1977, is amended to read as
   17  follows:
   18    S 13.  Acquisition of real property.  The corporation, upon  making  a
   19  finding  that it is necessary or convenient to acquire any real property
   20  for its immediate or future use, may acquire such property in any lawful
   21  manner, pursuant to the provisions of the eminent domain  procedure  law
   22  AND  FOR REAL PROPERTY ACQUISITIONS IN THE CITY OF NEW YORK, SECTION ONE
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                             [ ] is old law to be omitted.

    1  HUNDRED NINETY-SEVEN-C OF THE NEW YORK  CITY  CHARTER  RELATING  TO  THE
    2  UNIFORM  LAND  USE REVIEW PROCEDURE SHALL BE APPLICABLE, notwithstanding
    3  that such property may already be devoted to a  public  use,  nor  shall
    4  such  property  thereafter be taken for any other public use without the
    5  consent of the corporation.
    6    Prior to the commencement of condemnation proceedings, the corporation
    7  shall cause a survey and map to be made of the property to be  condemned
    8  and  file  the  same  in  its office.   There shall be annexed thereto a
    9  certificate, executed by such officer or employee as the corporation may
   10  designate, stating that the property described in such survey and map is
   11  necessary for corporate purposes.
   12    S 3.  This act shall take effect immediately.
