STATE OF NEW YORK ________________________________________________________________________ 5919 2021-2022 Regular Sessions IN ASSEMBLY March 2, 2021 ___________ Introduced by M. of A. LALOR -- read once and referred to the Committee on Governmental Operations AN ACT to amend the legislative law, in relation to reducing travel expenses and per diems for members of the legislature and eliminating per diems for members living less than one hundred twenty-five miles from the capitol The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (a) of subdivision 2 of section 5 of the legisla- 2 tive law, as added by section 7 of part CC of chapter 56 of the laws of 3 2015, is amended to read as follows: 4 (a) Each member of the legislature living more than one hundred twen- 5 ty-five miles from the state capitol, upon verification of attendance, 6 which shall be by electronic verification when practicable, in compli- 7 ance with the policies set forth by the speaker of the assembly and the 8 temporary president of the senate for their respective bodies, shall be 9 eligible to receive payment of actual and necessary travel expenses and 10 a per diem equivalent to the most recent federal per diem rates 11 published by the general services administration as set forth in 41 CFR 12 (Code of Federal Regulations) Part 301, App. A, for the time in which 13 the member was in travel status in the performance of his or her duties 14 during the months in which the legislature is scheduled to be in regular 15 session. During the months when the legislature is not scheduled to be 16 in regular session, members shall receive such actual and necessary 17 travel expenses and per diems, in compliance with verification policies 18 and in accord with standards and limits for reimbursable events set 19 forth by the speaker of the assembly and the temporary president of the 20 senate for their respective bodies as documented with receipts, not to 21 exceed one hundred dollars per day. The per diem allowances including 22 partial per diem allowances shall be made on audit and warrant of the 23 comptroller on vouchers approved by the temporary president of the 24 senate or his or her designee and speaker of the assembly or his or her 25 designee for their respective houses. 26 § 2.
