Bill Title: Prohibits cities which issue certain forms of identification to maintain the application information relating thereto; provides that the destruction of such information shall make the city liable for a civil penalty, payable to the office of new Americans, of $1,000 for each application or portion thereof that was destroyed; and requires such cities to submit such information to the division of homeland security and emergency services and to the office for new Americans.

        AN ACT to amend the general city law, in  relation  to  prohibiting  the
          destruction of information submitted by applicants for municipal forms
          of  identification,  and requiring such information to be submitted to
          the division of homeland  security  and  emergency  services  and  the
          office for new Americans
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. The general city law is amended by  adding  a  new  section
     2  18-e to read as follows:
     3    §  18-e. Forms of identification records. 1. Notwithstanding any local
     4  law, code, ordinance, rule or regulation to the contrary, no  city  that
     5  issues  any  form of identification to persons, who are not employees of
     6  such city, other than identification used solely as proof  of  residency
     7  in such city, shall destroy or cause to be destroyed any application, or
     8  the  information contained therein, for such form of identification. Any
     9  city that violates the provisions of this subdivision shall  be  subject
    10  to  a  civil  penalty,  payable  to the office for new Americans, of one
    11  thousand dollars for  each  application  or  portion  thereof  that  was
    12  destroyed.  The  proceeds  of  all  penalties collected pursuant to this
    13  subdivision shall be allocated and disbursed to the office for new Amer-
    14  icans to carry out its purpose pursuant to section ninety-four-b of  the
    15  executive law.
    16    2.  Within  ten  days of receipt of an application for a form of iden-
    17  tification issued by a city, such city  shall  forward  copies  of  such
    18  application  to the division of homeland security and emergency services
    19  and the office for new Americans.
    20    § 2. Every city which issued any  form  of  identification,  to  which
    21  section  18-e  of  the general city law, as added by section one of this
    22  act applies, prior to the effective date of this act, shall,  within  10

     1  days  of such effective date, transmit any and all information contained
     2  in the applications  for  such  identification,  which  remains  in  the
     3  possession  of such city, to the division of homeland security and emer-
     4  gency services and the office for new Americans.
     5    § 3. This act shall take effect immediately.
