                   CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY
       proposing an amendment to section 9 of article 1 of the constitution, in
         relation to authorizing gambling and the conducting of games of chance
         upon premises licensed to conduct both horse race meetings  and  pari-
         mutuel wagering thereon
    1    Section  1. Resolved (if the Senate concur), That section 9 of article
    2  1 of the constitution be amended by adding a new subdivision 3  to  read
    3  as follows:
    4    3. NOTWITHSTANDING SUBDIVISION ONE OF THIS SECTION, RACETRACKS AUTHOR-
    5  IZED TO CONDUCT EITHER HARNESS HORSE RACE MEETINGS OR THOROUGHBRED HORSE
    6  RACE MEETINGS AND PARI-MUTUEL WAGERING THEREON AS AUTHORIZED PURSUANT TO
    7  SUBDIVISION  ONE  OF THIS SECTION, MAY BE AUTHORIZED, BY LAW AND SUBJECT
    8  TO STATE LEGISLATIVE SUPERVISION AND CONTROL, TO  CONDUCT  GAMBLING  AND
    9  GAMES  OF  CHANCE UPON THE PREMISES OF SUCH A RACETRACK. THE STATE SHALL
   10  DERIVE A REASONABLE REVENUE FROM SUCH GAMBLING AND  GAMES  FOR  EXPENSES
   11  INCURRED  IN  THE  REGULATION THEREOF AND FOR THE SUPPORT OF GOVERNMENT.
   12  THE LEGISLATURE SHALL PASS APPROPRIATE LAWS TO  ESTABLISH  AND  MAINTAIN
   13  THEIR  SUPERVISION  AND  CONTROL OF THE CONDUCT OF GAMBLING AND GAMES OF
   14  CHANCE AUTHORIZED PURSUANT TO THIS SUBDIVISION INCLUDING, BUT NOT LIMIT-
   15  ED TO, LAWS TO DESCRIBE THE GAMES OF CHANCE THAT MAY  BE  CONDUCTED,  TO
   16  PREVENT  OFFENSES  AGAINST ANY OF THE PROVISIONS OF THIS SUBDIVISION, TO
   17  EFFECTUATE THE PURPOSES OF THIS SUBDIVISION, TO PREVENT PARTICIPATION BY
   18  CRIMINAL AND OTHER UNDESIRABLE ELEMENTS, AND TO PREVENT THE DIVERSION OF
   19  FUNDS FROM THE PURPOSES AUTHORIZED.
   20    S 2. Resolved (if the Senate concur), That the foregoing amendment  be
   21  referred  to  the  first regular legislative session convening after the
   22  next succeeding general election of members of  the  assembly,  and,  in
   23  conformity  with  section  1  of  article  19  of  the  constitution, be
   24  published for 3 months previous to the time of such election.
