STATE OF NEW YORK ________________________________________________________________________ 5204 2019-2020 Regular Sessions IN ASSEMBLY February 7, 2019 ___________ Introduced by M. of A. WALKER -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to carbon monoxide poisoning The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subparagraph (a) of paragraph 1 of subdivision (c) of 2 section 301 of the vehicle and traffic law, as amended by chapter 444 3 of the laws of 2016, is amended to read as follows: 4 (a) A safety inspection shall be made with respect to the brakes; 5 steering mechanism; wheel alignment; lights, including but not limited 6 to the lights which are designed and placed on a vehicle for the purpose 7 of illuminating the vehicle's license plates; odometer; tire pressure; 8 seat safety belts; shoulder harness safety belts; exhaust system for the 9 purposes of ensuring that carbon monoxide levels in the cab of the vehi- 10 cle have not reached unsafe levels in excess of 70 parts per million; 11 any window which is composed of, covered by or treated with any material 12 which has a light transmittance of less than seventy percent pursuant to 13 section three hundred seventy-five of this title and such other mech- 14 anisms and equipment as shall be determined by the commissioner to be 15 necessary for proper and safe operations. Such inspection shall also be 16 made with respect to vehicle identification number. Upon inspection, the 17 mileage appearing on the odometer shall be recorded upon the inspection 18 sticker. 19 § 2. The vehicle and traffic law is amended by adding a new section 20 397-c to read as follows: 21 § 397-c. Education against dangers of carbon monoxide poisoning. The 22 commissioner, in consultation with the chair of the consumer protection 23 board, shall prepare and distribute with each operator's license, wheth- 24 er issued or renewed, a pamphlet on the warning signs of carbon monoxide EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD05955-01-9A. 5204 2 1 poisoning and the appropriate actions to be taken to prevent such acci- 2 dental poisoning. 3 § 3. This act shall take effect on the one hundred eightieth day after 4 it shall have become a law. Effective immediately, the addition, amend- 5 ment and/or repeal of any rule or regulation necessary for the implemen- 6 tation of this act on its effective date are authorized and directed to 7 be made and completed on or before such effective date.
