       AN ACT to amend the workers' compensation law, in relation  to  enacting
         the "Lyme disease compensation act"
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Short title. This act shall be known and may  be  cited  as
    2  the "Lyme disease compensation act".
    3    S  2.  Paragraph  30  of  subdivision  2  of section 3 of the workers'
    4  compensation law, as renumbered by chapter 665 of the laws of  1971,  is
    5  renumbered  paragraph  31  and  a  new  paragraph 30 is added to read as
    6  follows:
    7      30. LYME DISEASE               30. ANY PROCESS INVOLVING FARMING,
    8      (LYME BORRCLIOSIS).            LANDSCAPING OPERATIONS, TREE
    9                                     PRUNING, SPRAYING, REPAIRING,
   10                                     OR RELATED OCCUPATION WHICH
   11                                     CREATES EXPOSURE TO LYME
   12                                     DISEASE CARRYING ORGANISMS
   13                                     OR CARE OR HANDLING OF ANIMALS.
   14    S 3. The closing paragraph of subdivision 2 of section 3 of the  work-
   15  ers' compensation law, as amended by chapter 666 of the laws of 1971, is
   16  amended to read as follows:
   17    Nothing  in paragraph [thirty] THIRTY-ONE of this subdivision shall be
   18  construed to apply to  any  disability  or  death  due  to  any  disease
   19  described in paragraph twenty-nine of this subdivision.
   20    S 4. This act shall take effect immediately.
