O'DONNELL -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to creating an affirmative defense to prostitution THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The penal law is amended by adding a new section 230.01 to 2 read as follows: 3 S 230.01 PROSTITUTION; DEFENSE. 4 IN ANY PROSECUTION UNDER SECTION 230.00 OF THIS ARTICLE OR SUBDIVISION 5 TWO OF SECTION 240.37 OF THIS PART, IT IS AN AFFIRMATIVE DEFENSE THAT 6 THE DEFENDANT'S PARTICIPATION IN THE OFFENSE WAS A RESULT OF BEING A 7 VICTIM OF SEX TRAFFICKING UNDER SECTION 230.34 OF THIS ARTICLE OR A 8 VICTIM OF TRAFFICKING IN PERSONS UNDER THE TRAFFICKING VICTIMS 9 PROTECTION ACT (UNITED STATES CODE, TITLE 22, CHAPTER 78). 10 S 2.
