STATE OF NEW YORK ________________________________________________________________________ 5067 2017-2018 Regular Sessions IN ASSEMBLY February 6, 2017 ___________ Introduced by M. of A. McDONOUGH -- read once and referred to the Committee on Transportation AN ACT to amend the highway law, the public authorities law and the New York city charter, in relation to causing the closed circuit tele- vision system of cameras to record certain images in a certain manner The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 10 of the highway law is amended by adding a new 2 subdivision 47 to read as follows: 3 47. Cause the closed-circuit television (CCTV) system of cameras 4 installed along certain state roadways as part of its intelligent trans- 5 portation systems program to record the images filmed by such cameras in 6 a manner that allows the identification of the license plate as well as 7 the make and model of the motor vehicles using such roadways. Such 8 recorded images are to be available only to law enforcement agencies 9 within the state for purposes of identifying motor vehicles that have 10 been driven in such manner as to have caused or been in some part 11 responsible for an accident or incident that has occurred on such road- 12 ways. 13 In carrying out this function, the commissioner shall amend any 14 departmental policies governing the CCTV systems so as to provide for 15 the recording of images as described in this subdivision. 16 § 2. Subdivision 1 of section 361 of the public authorities law is 17 amended by adding a new paragraph (f) to read as follows: 18 (f) The authority shall cause the closed-circuit television (CCTV) 19 system of cameras installed along the thruway to record the images 20 filmed by such cameras in a manner that allows the identification of the 21 license plate as well as the make and model of the motor vehicles using 22 such roadways. Such recorded images are to be available only to law 23 enforcement agencies within the state for purposes of identifying motor 24 vehicles that have been driven in such manner as to have caused or been EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. In carrying out this function, the authority shall amend 3 any policies governing the CCTV systems so as to provide for the record- 4 ing of images as described in this paragraph. 5 § 3. Subdivision a of section 2903 of the New York city charter is 6 amended by adding a new paragraph 11-a to read as follows: 7 (11-a) Cause the closed-circuit television (CCTV) system of cameras 8 installed along certain roadways of the city as part of its intelligent 9 transportation systems program to record the images filmed by such 10 cameras in a manner that allows the identification of the license plate 11 as well as the make and model of the motor vehicles using such roadways. 12 Such recorded images are to be available only to law enforcement agen- 13 cies within the city for purposes of identifying motor vehicles that 14 have been driven in such manner as to have caused or been in some part 15 responsible for an accident or incident that has occurred on such road- 16 ways. 17 In carrying out this function, the commissioner shall amend any 18 departmental policies governing the CCTV systems so as to provide for 19 the recording of images as described in this subdivision. 20 § 4. This act shall take effect on the thirtieth day after it shall 21 have become a law.
