          tee on Environmental Conservation

        AN ACT directing the department of environmental conservation to conduct
          a study on the life cycle of battery use and disposal; directing  such
          department  to develop options and recommendations for a battery recy-
          cling collection program and a battery recycling outreach  and  educa-
          tion  program;  and  providing  for the repeal of such provisions upon
          expiration thereof

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1. The department of environmental conservation is authorized
     2  and directed to conduct a study on the life cycle  of  battery  use  and
     3  disposal.
     4    § 2. The scope of the study shall include, but not be limited to:
     5    (a) environmentally sound battery recycling practices;
     6    (b) existing battery recycling programs;
     7    (c)  funding  of  a  battery recycling program, with consideration for
     8  battery producers funding the program;
     9    (d) current hazardous waste plans;
    10    (e) methods of  battery  collection  which  includes  an  emphasis  on
    11  convenience for customers;
    12    (f)  analysis  of statewide, local, or joint governance over a battery
    13  recycling collection program;
    14    (g) transportation of batteries recycled through a  battery  recycling
    15  collection program;
    16    (h) how to implement a battery recycling collection program throughout
    17  the state given its varied population densities; and
    18    (i)  the use of battery stewardship organizations in a battery recycl-
    19  ing collection program.

     1    § 3. The department of  environmental  conservation  shall  provide  a
     2  report to the governor and the legislature on or before January 1, 2023.
     3  Such report shall include:
     4    (a)  an analysis of options for a battery recycling collection program
     5  which include transparent reporting and performance goals for  responsi-
     6  ble parties;
     7    (b) an analysis of options for a battery recycling outreach and educa-
     8  tion program; and
     9    (c)  recommendations on both battery recycling collection programs and
    10  battery recycling outreach and education programs.
    11    § 4. This act shall take effect immediately and shall  expire  and  be
    12  deemed repealed April 1, 2023.
