CROUCH -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to big game hunting in Broome county THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The opening paragraph of paragraph a of subdivision 2 of 2 section 11-0907 of the environmental conservation law, as amended by 3 chapter 600 of the laws of 1993, is amended and a new item (k) is added 4 to read as follows: 5 Regular open hunting seasons for [deer] BIG GAME are established sepa- 6 rately for the named regions or parts of regions, or named counties 7 listed in column one of the table set forth in this subdivision, and are 8 specified as seasons for taking by pistol, rifle, shotgun or long bow, 9 or for taking by shotgun or long bow only, or for taking by long bow 10 only, as indicated in column three entitled "Manner of Taking". Where 11 taking of big game by shotgun is permitted by this chapter such shotgun 12 may contain rifling in all or a portion of the barrel, provided, howev- 13 er, if the barrel or a portion thereof does contain rifling only shells 14 having non-metallic cases, except for the base, may be used. In the 15 areas identified in column one except in the "closed areas" specified in 16 subdivision 5 the game specified in column two may be taken in the open 17 season stated in column two immediately following the specification of 18 the game, in the manner specified in column three. 19 (K) BROOME COUNTY DEAR AND BEAR, PISTOL, SHOTGUN, 20 THE FIRST MONDAY MUZZLE 21 AFTER NOVEMBER 15 LOADING FIREARM, 22 THROUGH THE FIRST RIFLE OR LONG 23 TUESDAY AFTER BOW ONLY 24 DECEMBER 7 EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. Items (f) and (i) of paragraph a of subdivision 2 of section 2 11-0907 of the environmental conservation law, item (f) as amended by 3 section 3 of chapter 323 of the laws of 2011 and item (i) as amended by 4 chapter 231 of the laws of 2012, are amended to read as follows: 5 (f) Southern tier, Deer and bear, Pistol, shotgun, 6 central and Western first Monday after muzzle loading 7 region, except those November 15 firearm or 8 counties or portions through first long bow only 9 thereof listed in Tuesday after 10 item (i) [or], December 7 11 (j) OR (K) of 12 this paragraph 13 (i) The counties of Deer, the first Monday Pistol, shotgun, 14 Allegany, Cattaraugus, after November 15 muzzle loading 15 Cayuga, Chautauqua through first Tuesday firearm, rifle or 16 except that portion after December 7 long bow only 17 of the county north 18 of route 20, Chemung, 19 Chenango, Herkimer, 20 Madison, 21 Montgomery, Oneida, 22 Oswego, Otsego, 23 Schoharie, Schuyler, 24 Steuben, Tioga, 25 Wyoming and Yates 26 [and that portion of 27 the county of 28 Broome east of the 29 Susquehanna river] 30 S 3. Items (f) and (i) of paragraph a of subdivision 2 of section 31 11-0907 of the environmental conservation law, item (f) as separately 32 amended by chapter 108 of the laws of 1995 and section 1 of chapter 600 33 of the laws of 2005 and item (i) as separately amended by chapter 441 of 34 the laws of 2009 and chapter 231 of the laws of 2012, are amended to 35 read as follows: 36 (f) Southern tier, Deer, first Pistol, shotgun, 37 central and Western Monday after November muzzle loading firearm 38 region, except those 15 through first or long bow only 39 counties or portions Tuesday after 40 thereof listed in December 7 41 item (i) OR (K) of 42 this paragraph 43 (i) The counties of Deer, the Pistol, shotgun, 44 Allegany, Cattaraugus, first Monday after muzzle loading 45 Cayuga, Chemung, November 15 through firearm, rifle or 46 Chenango, Herkimer, first Tuesday after long bow only 47 Madison, Montgomery, December 7 48 Oneida, Oswego, 49 Otsego, Schoharie, 50 Schuyler, Steuben, 51 Tioga and Yates 52 [and that portion of A. 4821 3 1 the county of 2 Broome east of the 3 Susquehanna river] 4 S 4. Item (i) of paragraph a of subdivision 2 of section 11-0907 of 5 the environmental conservation law, as amended by section 2 of chapter 6 600 of the laws of 2005, is amended to read as follows: 7 (i) The counties of Deer and bear, the Pistol, shotgun, 8 Allegany, BROOME, first Monday after muzzle loading 9 Cattaraugus, November 15 through firearm, rifle or 10 Chenango, Herkimer, first Tuesday after long bow only 11 Montgomery, Oneida, December 7 12 Oswego, Otsego, 13 Schoharie and Tioga 14 [and that portion 15 of the county 16 of Broome east of the 17 Susquehanna river] 18 S 5. This act shall take effect immediately, provided, however that: 19 a. the amendments to paragraph a of subdivision 2 of section 11-0907 20 of the environmental conservation law made by section one of this act 21 shall not affect the expiration of such paragraph and shall be deemed to 22 expire therewith; 23 b. the amendments to items (f) and (i) of paragraph a of subdivision 2 24 of section 11-0907 of the environmental conservation law made by section 25 two of this act shall be subject to the expiration and reversion of such 26 items when upon such date the provisions of section three of this act 27 shall take effect; 28 c. the amendments to items (f) and (i) of paragraph a of subdivision 2 29 of section 11-0907 of the environmental conservation law made by section 30 three of this act shall be subject to the expiration and reversion of 31 such paragraph, when upon such date the provisions of section four of 32 this act shall take effect.
