Bill Title: Prohibits the operation of a motor vehicle with a video monitor that plays pre-recorded programming or other similar means of visually displaying a television broadcast or video signal that produces entertainment or business applications within view of the operator of such vehicle or where the monitor is located at any point forward of the back of the driver's seat; prevents distracted driving.

WRIGHT -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to operation of a motor vehicle with a video monitor or screen THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subdivision 24 of section 375 of the vehicle and traffic 2 law, as amended by chapter 39 of the laws of 1989, is amended to read as 3 follows: 4 24. It shall be unlawful to operate upon any public STREET, ROAD OR 5 highway in this state a motor vehicle which is equipped with a tele- 6 vision receiving set, OR A VIDEO MONITOR OR SCREEN UPON WHICH ANY MEANS 7 OF VISUALLY DISPLAYING A TELEVISION BROADCAST OR VIDEO SIGNAL THAT 8 PRODUCES ENTERTAINMENT OR BUSINESS APPLICATIONS MAY BE DISPLAYED, AT ANY 9 POINT FORWARD OF THE BACK OF THE DRIVER'S SEAT, OR within view of the 10 operator or in which a television receiving set is in operation within 11 the view of the operator OR IN WHICH A VIDEO MONITOR OR SCREEN DISPLAY- 12 ING ANY MEANS OF VISUALLY DISPLAYING A TELEVISION BROADCAST OR VIDEO 13 SIGNAL THAT PRODUCES ENTERTAINMENT OR BUSINESS APPLICATIONS WITHIN THE 14 VIEW OF THE OPERATOR. A motor vehicle shall not be deemed to be 15 equipped with a television receiving set OR SUCH A VIDEO MONITOR OR 16 SCREEN solely because such set, MONITOR OR SCREEN utilizes power from 17 such vehicle. The provisions of this subdivision shall not prohibit a 18 vehicle with a weight of ten thousand pounds or more or a school bus 19 from using closed-circuit television receiving equipment exclusively for 20 safety and maneuvering purposes, in accordance with regulations to be 21 established by the commissioner. NO RETAILER SHALL INSTALL IN ANY MOTOR 22 VEHICLE, ANY VIDEO MONITOR OR SCREEN UPON WHICH ANY MEANS OF VISUALLY 23 DISPLAYING A TELEVISION BROADCAST OR VIDEO SIGNAL THAT PRODUCES ENTER- 24 TAINMENT OR BUSINESS APPLICATIONS AT ANY POINT FORWARD OF THE BACK OF 25 THE DRIVER'S SEAT, OR WITHIN THE VIEW OF THE OPERATOR OF THE MOTOR VEHI- EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. FURTHERMORE, THE PROVISIONS OF THIS SUBDIVISION SHALL NOT APPLY TO 2 (A) THE VIDEO MONITOR OR SCREEN ON ANY GLOBAL POSITIONING OR NAVIGA- 3 TIONAL SYSTEM, MAPPING DISPLAY OR OTHER DISPLAY UTILIZED TO ENHANCE THE 4 EXTERIOR VIEW FOR THE PURPOSE OF MANEUVERING THE MOTOR VEHICLE, (B) ANY 5 TELEVISION RECEIVING SET, OR VIDEO MONITOR OR SCREEN, IF SUCH EQUIPMENT 6 OR MOTOR VEHICLE IS EQUIPPED WITH A DEVICE THAT DISABLES SUCH EQUIPMENT 7 WHILE SUCH VEHICLE IS OPERATED UPON A PUBLIC HIGHWAY, (C) ANY MOBILE 8 DIGITAL TERMINAL IN AN AUTHORIZED EMERGENCY VEHICLE, OR (D) ANY TELE- 9 VISION RECEIVING SET OR VIDEO MONITOR OR SCREEN IN A SELF-CONTAINED 10 MOTOR HOME IN EXCESS OF TWENTY OPEN FEET IN LENGTH. 11 S 2. This act shall take effect on the first of September next 12 succeeding the date on which it shall have become a law.
