BENJAMIN, BOYLAND, ESPAILLAT, GREENE, POWELL, TOWNS, WRIGHT -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to the panel for educa- tional policy in the city of New York THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subdivision 3 of section 2590-a of the education law, as 2 added by chapter 330 of the laws of 1969, is amended to read as follows: 3 3. City board. The term "city board" shall mean the [board of educa- 4 tion of the city district] PANEL FOR EDUCATIONAL POLICY. 5 S 2. Subdivision 1 of section 2590-b of the education law, as added by 6 chapter 91 of the laws of 2002, is amended to read as follows: 7 1. (a) The board of education of the city school district of the city 8 of New York is hereby continued AS THE PANEL FOR EDUCATIONAL POLICY. 9 Such [board of education] PANEL FOR EDUCATIONAL POLICY shall consist of 10 thirteen members: one member to be appointed by each borough president 11 of the city of New York; seven members to be appointed by the mayor of 12 the city of New York; and the chancellor. The chancellor shall serve as 13 the chairperson of the [city board] PANEL FOR EDUCATIONAL POLICY. All 14 twelve appointed members shall serve at the pleasure of the appointing 15 authority [and]. A MEMBER SHALL BE PROVIDED WITH A NOTICE OF DISCHARGE, 16 DISMISSAL OR A REQUEST FOR RESIGNATION OF SUCH MEMBER, NOT LESS THAN 17 THIRTY DAYS PRIOR TO THE EFFECTIVE DATE OF SUCH ACTION. NOTWITHSTANDING 18 SUCH NOTICE, SUCH MEMBER SHALL RETAIN ALL RIGHTS, DUTIES AND OBLIGATIONS 19 OF MEMBERSHIP ON SUCH BOARD UNTIL SUCH EFFECTIVE DATE. NO MEMBER shall 20 [not] be employed in any capacity by the city of New York, or a subdivi- 21 sion thereof, or the [city board] PANEL FOR EDUCATIONAL POLICY. Each 22 borough president's appointee shall be a resident of the borough for 23 which the borough president appointing him or her was elected and shall 24 be the parent of a child attending a public school within the city EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. Any vacancy shall be filled by appointment by 3 the appropriate appointing authority. Notwithstanding any provision of 4 local law, the members of [the board] SUCH PANEL shall not have staff, 5 offices, or vehicles assigned to them or receive compensation for their 6 services, but shall be reimbursed for the actual and necessary expenses 7 incurred by them in the performance of their duties. 8 (b) The [city board] PANEL FOR EDUCATIONAL POLICY shall hold at least 9 twelve meetings per year; any additional meetings may be called at the 10 request of the chancellor. 11 S 3. This act shall take effect immediately; provided however that the 12 amendments to subdivision 1 of section 2590-b of the education law made 13 by section two of this act shall not affect the expiration of such 14 subdivision and shall be deemed to expire therewith.
