       AN ACT to amend the education law, in relation to a  change  in  circum-
         stance  of income and providing for the repeal of such provisions upon
         expiration thereof
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Subdivision  5  of  section  663  of the education law is
    2  amended by adding a new paragraph (c) to read as follows:
    3    (C) WHEN MAKING ADJUSTMENTS TO INCOME FOR CHANGE IN CIRCUMSTANCE,  THE
    4  CORPORATION  SHALL,  PURSUANT  TO  RULES  AND  REGULATIONS,  INCLUDE THE
    5  FOLLOWING AS CAUSES  FOR  CHANGE  IN  STATUS  OF  THE  APPLICANT:    (I)
    6  CATASTROPHIC  ILLNESS  OF  THE  APPLICANT; AND (II) THE APPLICANT OR THE
    7  SPOUSE OF THE APPLICANT BEING CALLED TO ACTIVE MILITARY DUTY.
    8    S 2. This act shall take effect immediately and shall  expire  and  be
    9  deemed repealed June 30, 2012.
