SOLAGES -- read once and referred to the Commit- tee on Racing and Wagering -- reported from committee, advanced to a third reading, amended and ordered reprinted, retaining its place on the order of third reading -- again amended on third reading, ordered reprinted, retaining its place on the order of third reading AN ACT to amend the racing, pari-mutuel wagering and breeding law, in relation to the composition of the local advisory board for the Belmont racetrack facility The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 6 of section 212 of the racing, pari-mutuel 2 wagering and breeding law, as added by chapter 18 of the laws of 2008, 3 is amended to read as follows: 4 6. Within thirty days following the appointment of the members of the 5 franchise oversight board, the members of the oversight board shall 6 establish a local advisory board for each racing operation comprised of 7 the following members to meet at least twice yearly: 8 a. The local advisory board for the Saratoga racetrack facility shall 9 be comprised of fifteen members and include five designees from each of 10 the following: the board of supervisors, the mayor of the city of Sara- 11 toga and the franchised corporation. 12 b. The local advisory board for the Aqueduct racetrack facility shall 13 be comprised of fifteen members, nine of whom shall be designees of New 14 York City Queens Community Board Ten, three designees of the franchised 15 corporation and three designees of the video lottery gaming operator. 16 c. The local advisory board for the Belmont racetrack facility shall 17 be comprised of fifteen members to be appointed as follows: 18 (i) Five members from Nassau county to be appointed by the Nassau 19 county executive. Four of such members must reside in the hamlet of 20 Elmont. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD05145-06-9A. 2317--B 2 1 (ii) Two members from the town of Hempstead to be appointed by the 2 supervisor of the town of Hempstead. Both members must reside in the 3 hamlet of Elmont. 4 (iii) Two members to be appointed by the mayor of the village of 5 Floral Park, subject to village board approval. 6 (iv) One member to be appointed by the mayor of the village of South 7 Floral Park, subject to village board approval. 8 (v) Three members to be appointed by the New York Racing Association, 9 Inc. 10 (vi) Two members to be appointed by the New York City Queens Community 11 Board 13. 12 The members of the local advisory boards shall serve for a period of 13 two years. In the event of a vacancy occurring during a term of appoint- 14 ment by reason of death, resignation, disqualification or otherwise such 15 vacancy shall be filled for the unexpired term in the same manner as the 16 original appointment. The members of the local advisory board shall 17 serve without compensation, except that each member shall be allowed the 18 necessary and actual expenses incurred in the performance of his or her 19 duties pursuant to this section. 20 § 2. This act shall take effect immediately.
