STATE OF NEW YORK ________________________________________________________________________ 2238 2017-2018 Regular Sessions IN ASSEMBLY January 17, 2017 ___________ Introduced by M. of A. PEOPLES-STOKES, MOSLEY -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to the liability of health care practitioner volunteers The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 4 of section 260 of the public health law, as 2 amended by chapter 84 of the laws of 2006, is amended to read as 3 follows: 4 4. [No health care practitioner volunteer shall participate in the5health care practitioner volunteer program established pursuant to this6title unless, with respect to acts and omissions that occurred or7allegedly occurred within the scope of his or her participation in such8program, he or she is covered by an adequate professional liability9insurance policy.] A health care practitioner volunteer shall be deemed 10 to be an "employee" for purposes of section seventeen of the public 11 officers law with respect to any acts and omissions that occurred or 12 allegedly occurred within the scope of his or her participation in such 13 program. 14 § 2.
