       AN ACT to amend the insurance law, in relation  to  prohibiting  charges
         for  comprehensive  coverage  of  a  rental  vehicle due to loss of an
         insured's vehicle if the insured policy holder is between the ages  of
         eighteen and twenty-five
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 2336 of the insurance law is amended  by  adding  a
    2  new subsection (i) to read as follows:
    3    (I)  NO  SCHEDULE  OR RATING PLAN FOR NON-COMMERCIAL PRIVATE PASSENGER
    4  AUTOMOBILE INSURANCE SHALL INCLUDE A PREMIUM  CHARGE  FOR  COMPREHENSIVE
    5  COVERAGE, OPTIONAL OR OTHERWISE, FOR COVERAGE OF A RENTAL VEHICLE DUE TO
    6  LOSS  OF  USE  OF  AN  INSURED'S  VEHICLE IF THE INSURED POLICYHOLDER IS
    7  BETWEEN THE AGES OF EIGHTEEN AND TWENTY-FIVE.  THE FOREGOING  SHALL  NOT
    8  BE  APPLICABLE IF THE SUPERINTENDENT DETERMINES THAT A SUFFICIENT MARKET
    9  FOR RENTAL VEHICLES EXISTS FOR PERSONS IN THIS AGE GROUP ON A COUNTY  BY
   10  COUNTY BASIS.
   11    S 2. This act shall take effect on the one hundred twentieth day after
   12  it shall have become a law and shall apply to any insurance policies and
   13  contracts  issued,  renewed, modified or altered on or after such effec-
   14  tive date.
