STATE OF NEW YORK ________________________________________________________________________ 1262 2021-2022 Regular Sessions IN ASSEMBLY January 8, 2021 ___________ Introduced by M. of A. HEVESI -- read once and referred to the Committee on Social Services AN ACT to amend the social services law, in relation to working with the USDA to receive approvals and develop online fresh food purchasing options throughout the state; and to amend a chapter of the laws of 2020 amending the social services law relating to using supplemental nutrition assistance program benefits to purchase online groceries and to the state supplemental nutrition assistance program outreach program, as proposed in legislative bills numbers S. 8247-A and A. 10673, in relation to the effectiveness thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (b) of subdivision 1 of section 95 of the social 2 services law, as added by a chapter of the laws of 2020 amending the 3 social services law relating to using supplemental nutrition assistance 4 program benefits to purchase online groceries and to the state supple- 5 mental nutrition assistance program outreach program, as proposed in 6 legislative bills numbers S. 8247-A and A. 10673, is amended to read as 7 follows: 8 (b) [The] Subject to an online food purchasing program operated by the 9 United States department of agriculture, food and nutrition service 10 (USDA), the office shall promptly seek any necessary [federal approval11needed to enter into an agreement with all grocery retailers prepared to12offer SNAP online purchasing or subsequently available programs] 13 approvals from the USDA in order to maximize availability of online 14 fresh food purchasing options throughout the state. Within one hundred 15 eighty days after the effective date of this paragraph, the office shall 16 work with the USDA to develop a plan seeking to maximize retailer 17 participation in the USDA's SNAP online purchasing [options] program in 18 the state. The office shall periodically review the plan and revise the 19 plan as necessary. The plan, and any updates of such plan, shall be EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. The office shall continue to seek all 3 necessary waivers from the [United States department of agriculture,4food and nutrition service] USDA, to the extent necessary [for the5office to carry out the plan, pursuant to federal law and regulations] 6 to implement the program. 7 § 2. Section 4 of a chapter of the laws of 2020 amending the social 8 services law relating to using supplemental nutrition assistance program 9 benefits to purchase online groceries and to the state supplemental 10 nutrition assistance program outreach program, as proposed in legisla- 11 tive bills numbers S. 8247-A and A. 10673, is amended to read as 12 follows: 13 § 4. This act shall take effect immediately and shall expire and be 14 deemed repealed three years after such effective date. 15 § 3. This act shall take effect on the same date and in the same 16 manner as a chapter of the laws of 2020 amending the social services law 17 relating to using supplemental nutrition assistance program benefits to 18 purchase online groceries and to the state supplemental nutrition 19 assistance program outreach program, as proposed in legislative bills 20 numbers S. 8247-A and A. 10673, takes effect.
