STATE OF NEW YORK ________________________________________________________________________ 1202 2021-2022 Regular Sessions IN ASSEMBLY January 7, 2021 ___________ Introduced by M. of A. SEAWRIGHT, SIMON, EICHENSTEIN, DICKENS, ROZIC, GALEF -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to mandated training or coun- seling in hate crime prevention and education for individuals convicted of hate crimes The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 5 of section 485.10 of the penal law, as added 2 by chapter 158 of the laws of 2010, is amended to read as follows: 3 5. In addition to any of the dispositions authorized by this chapter, 4 the court [may] shall require as part of the sentence imposed upon a 5 person convicted of a hate crime pursuant to this article, that the 6 defendant complete a program, training session or counseling session 7 directed at hate crime prevention and education, where the court deter- 8 mines such program, training session or counseling session is appropri- 9 ate, available and was developed or authorized by the court or local 10 agencies in cooperation with organizations serving the affected communi- 11 ty. 12 § 2.
