STATE OF NEW YORK ________________________________________________________________________ 972 2019-2020 Regular Sessions IN ASSEMBLY January 14, 2019 ___________ Introduced by M. of A. L. ROSENTHAL -- read once and referred to the Committee on Insurance AN ACT to amend the insurance law, in relation to prohibiting co-pay- ments for treatment at an opioid treatment program The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subsection (i) of section 3216 of the insurance law is 2 amended by adding a new paragraph 31-b to read as follows: 3 (31-b) Every policy that provides coverage for treatment at an opioid 4 treatment program shall not impose a co-payment fee on any insured for 5 such treatment. For the purposes of this section "opioid treatment 6 program" means a program or practitioner engaged in opioid treatment of 7 individuals with an opioid agonist treatment medication. 8 § 2. Subsection (l) of section 3221 of the insurance law is amended by 9 adding a new paragraph 7-c to read as follows: 10 (7-c) Every policy that provides coverage for treatment at an opioid 11 treatment program shall not impose a co-payment fee on any insured for 12 such treatment. For the purposes of this section "opioid treatment 13 program" means a program or practitioner engaged in opioid treatment of 14 individuals with an opioid agonist treatment medication. 15 § 3. Section 4303 of the insurance law is amended by adding a new 16 subsection (l-3) to read as follows: 17 (l-3) Every policy that provides coverage for treatment at an opioid 18 treatment program shall not impose a co-payment fee on any insured for 19 such treatment. For the purposes of this section "opioid treatment 20 program" means a program or practitioner engaged in opioid treatment of 21 individuals with an opioid agonist treatment medication. 22 § 4. This act shall take effect on the first of January next succeed- 23 ing the date on which it shall have become a law and shall apply to 24 policies and contracts issued, renewed, modified, altered or amended on 25 and after such date.
