STATE OF NEW YORK ________________________________________________________________________ 693 2023-2024 Regular Sessions IN ASSEMBLY January 11, 2023 ___________ Introduced by M. of A. CARROLL -- read once and referred to the Commit- tee on Transportation AN ACT to amend the vehicle and traffic law, in relation to requiring the suspension of the license to operate a motor vehicle of any person who was operating a motor vehicle at the time of an accident which resulted in a fatality The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph b of subdivision 2 of section 510 of the vehicle 2 and traffic law is amended by adding a new subparagraph (xviii) to read 3 as follows: 4 (xviii) for a period no less than sixty days but no later than the 5 successful completion of the requirements set forth under this subpara- 6 graph where the holder was operating a motor vehicle at the time of an 7 accident which resulted in a fatality. A person whose license was 8 suspended under this subparagraph shall not have their license restored 9 before the successful recompletion of all requirements under subdivision 10 four of section five hundred two of this article for such license which 11 shall not take place before the sixtieth day after the accident which 12 resulted in the suspension. 13 § 2. This act shall take effect on the first of September next 14 succeeding the date on which it shall have become a law. Effective imme- 15 diately, the addition, amendment and/or repeal of any rule or regulation 16 necessary for the implementation of this act on its effective date are 17 authorized to be made and completed on or before such effective date.
