FARRELL, GLICK, PERRY -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to adjusting the mainte- nance amount for the city school district of the city of New York THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Paragraph b of subdivision 5-a of section 2576 of the 2 education law, as added by chapter 91 of the laws of 2002, is amended to 3 read as follows: 4 b. The city amount shall not be less than the city amount appropriated 5 in the base year as determined at the time of adoption of the budget for 6 the ensuing fiscal year[. Provided, however, in] ADJUSTED TO REFLECT THE 7 FIVE YEAR AVERAGE PERCENTAGE CHANGE IN THE CONSUMER PRICE INDEX FOR ALL 8 URBAN CONSUMERS IN THE NEW YORK-NORTHERN NEW JERSEY-LONG ISLAND PORTION 9 OF THE NEW YORK-NORTHERN NEW JERSEY-LONG ISLAND, NEW YORK-NEW 10 JERSEY-PENNSYLVANIA METROPOLITAN STATISTICAL AREA, (CPI-U) AS SUCH IS 11 DEFINED BY THE UNITED STATES DEPARTMENT OF LABOR AND TO INCLUDE AN ADDI- 12 TIONAL TWO BILLION TWO HUNDRED MILLION DOLLARS IN EXCESS OF THE TOTAL 13 AMOUNT OF EXPENDITURES FOR THE TWO THOUSAND SIX--TWO THOUSAND SEVEN BASE 14 YEAR PURSUANT TO SECTION THIRTEEN-A OF PART B OF CHAPTER FIFTY-SEVEN OF 15 THE LAWS OF TWO THOUSAND SEVEN, SUBJECT TO THE PROVISIONS OF THIS 16 SECTION. IN ACCORDANCE WITH SUBPARAGRAPH (II) OF PARAGRAPH A OF THIS 17 SUBDIVISION, THE CITY OF NEW YORK'S CONTRIBUTION OF TWO BILLION TWO 18 HUNDRED MILLION DOLLARS, PURSUANT TO SECTION THIRTEEN-A OF PART B OF 19 CHAPTER FIFTY-SEVEN OF THE LAWS OF TWO THOUSAND SEVEN SHALL NOT INCLUDE 20 CITY PAYMENTS TO BOND OR NOTE HOLDERS FOR DEBT SERVICE OR PAYMENTS FOR 21 EMPLOYEE PENSION BENEFITS. IN the event the total amount of city funds 22 relied upon to balance such budget is lower than the total amount of 23 city funds appropriated in the base year, determined at the time of EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD04012-01-5 A. 675 2 1 adoption of such budget, the city amount may be reduced by up to the 2 same percentage as the overall percentage decrease in city funds between 3 the base year and the ensuing fiscal year. 4 S 2. This act shall take effect immediately; provided however, that 5 the amendments to paragraph b of subdivision 5-a of section 2576 of the 6 education law as made by section one of this act shall not affect the 7 repeal of such subdivision and shall be deemed repealed therewith.
