       AN  ACT to amend the parks, recreation and historic preservation law, in
         relation to waiver of certain fees
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 13.15 of the parks, recreation and historic preser-
    2  vation  law  is  amended  by  adding  a  new  subdivision 3-a to read as
    3  follows:
    4    3-A. NOTWITHSTANDING ANY OTHER  PROVISION  OF  LAW  TO  THE  CONTRARY,
    5  SENIOR CITIZENS SHALL BE ENTITLED TO USE ANY PARK, RECREATIONAL FACILITY
    6  OR  HISTORIC  SITE  UNDER  THE  JURISDICTION OF THE OFFICE UPON THE SAME
    7  TERMS AND CONDITIONS AS APPLY TO THE GENERAL  PUBLIC,  BUT  WITHOUT  THE
    8  PAYMENT  OF  ANY FEE OR OTHER CHARGE FOR SUCH USE.  FOR PURPOSES OF THIS
    9  SUBDIVISION THE TERM "SENIOR CITIZENS"  SHALL  MEAN  PERSONS  SIXTY-FIVE
   10  YEARS OF AGE OR OLDER.
   11    S  2.  This  act shall take effect on the ninetieth day after it shall
   12  have become a law, provided that the commissioner of  parks,  recreation
   13  and  historic  preservation  shall  promulgate any rules and regulations
   14  necessary for the timely implementation of this  act  on  its  effective
   15  date on or before such date.
