ENGLEBRIGHT, HAWLEY -- read once and referred to the Committee on Ways and Means AN ACT to amend the state finance law, in relation to providing state aid to municipalities to offset the costs and expenses of providing public safety services that are necessary as a result of the presence of a residential institution located in such municipality The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The state finance law is amended by adding a new section 2 54-n to read as follows: 3 § 54-n. State aid to offset costs and expenses of certain public safe- 4 ty services. 1. For purposes of this section, the following terms shall 5 have the following meanings: 6 a. "host municipality" shall mean a municipality in which a residen- 7 tial institution is located, either in whole or in part. 8 b. "residential institution" shall mean any four year residential 9 school, college or university of the state university of New York. 10 c. "municipality" shall mean a county, town, city or village located 11 in this state. 12 2. Within the amount appropriated therefor, each host municipality 13 shall receive aid according to the formula set forth in subdivision 14 three of this section. Aid received by a host municipality shall be used 15 by such host municipality as follows: 16 a. fifty percent of such aid received shall be used to offset the 17 costs and expenses of providing public safety services that are neces- 18 sary as a result of the presence of a residential institution located in 19 such host municipality; and 20 b. fifty percent of such aid received shall be used to reduce the real 21 property tax levied by such host municipality. The amount of aid made available to a host municipality to offset 2 the costs and expenses of providing public safety services shall be the 3 difference in the cost between the per student cost for the provision of 4 public safety services by the host municipality less any per student aid 5 and incentives for municipalities funding received by such host munici- 6 pality from the state, multiplied by the student population in attend- 7 ance at the residential institution located in such host municipality. 8 If a residential institution is located in two or more host munici- 9 palities, the amount of aid made available pursuant to this subdivision 10 shall be distributed among such host municipalities pursuant to an 11 intermunicipal agreement setting forth a distribution formula that shall 12 be approved by each of the legislative bodies of such host munici- 13 palities. 14 4. Payments made pursuant to this section shall be made on or before 15 July first of each year. 16 § 2. This act shall take effect immediately.
