STATE OF NEW YORK ________________________________________________________________________ 366 2017-2018 Regular Sessions IN ASSEMBLY January 5, 2017 ___________ Introduced by M. of A. ENGLEBRIGHT -- read once and referred to the Committee on Correction AN ACT to amend the correction law, in relation to directing the divi- sion of criminal justice services to notify the appropriate agencies, within 48 hours of the receipt of a change of address, or of enroll- ment, attendance, employment or residence at an institution of higher education by a sex offender The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivisions 1, 3 and 4 of section 168-j of the correction 2 law, as amended by a chapter of the laws of 2016 amending the correction 3 law relating to directing the division of criminal justice services to 4 notify the appropriate agencies, within 48 hours of the receipt of a 5 change of address, or of enrollment, attendance, employment or residence 6 at an institution of higher education by a sex offender, as proposed in 7 legislative bills numbers A.9239 and S.7252, are amended to read as 8 follows: 9 1. Upon receipt of a change of address by a sex offender required to 10 register under this article, but in any event no more than [forty-eight11hours] two business days after such receipt, the division shall notify 12 the local law enforcement agency having jurisdiction of the new place of 13 residence and the local law enforcement agency where the sex offender 14 last resided of the new place of residence. 15 3. The division shall, if the sex offender changes residence to anoth- 16 er state, notify the appropriate agency within that state of the new 17 place of residence [within forty-eight hours]. 18 4. Upon receipt of a change in the status of the enrollment, attend- 19 ance, employment or residence at an institution of higher education by a 20 sex offender required to register under this article, but in any event 21 no more than [forty-eight hours] two business days after such receipt, EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. This act shall take effect on the same date and in the same 4 manner as a chapter of the laws of 2016 amending the correction law 5 relating to directing the division of criminal justice services to noti- 6 fy the appropriate agencies, within 48 hours of the receipt of a change 7 of address, or of enrollment, attendance, employment or residence at an 8 institution of higher education by a sex offender, as proposed in legis- 9 lative bills numbers A.9239 and S.7252, takes effect.
