STATE OF NEW YORK ________________________________________________________________________ 75 2017-2018 Regular Sessions IN ASSEMBLY (Prefiled) January 4, 2017 ___________ Introduced by M. of A. CAHILL -- read once and referred to the Committee on Higher Education AN ACT to amend the education law, in relation to including the alterna- tive and complementary integration and application of scientific prin- ciples in the scope of the practice of dietetics and nutrition The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 8001 of the education law, as added by chapter 635 2 of the laws of 1991, is amended to read as follows: 3 § 8001. Definitions. 1. Dietetics and nutrition are herein each 4 defined as the integration and application of principles derived from 5 the sciences of nutrition, biochemistry, physiology, food management and 6 behavioral and social sciences, including the alternative and complemen- 7 tary integration and application of such principles, to achieve and 8 maintain people's health and for healing. 9 2. Where the title "certified dietitian" or "certified nutritionist" 10 is used in this article it shall mean "certified dietitian", "certified 11 dietician", [or] "certified nutritionist", or "certified nutrition 12 specialist". 13 3. A certified dietitian or certified nutritionist is one who engages 14 in the integration and application of principles derived from the 15 sciences of nutrition, biochemistry, physiology, food management and 16 behavioral and social sciences, including the alternative and complemen- 17 tary integration and application of such principles, to achieve and 18 maintain people's health and for healing, and who is certified as such 19 by the department pursuant to section eight thousand four of this arti- 20 cle. The primary function of a certified dietitian or certified nutri- 21 tionist is the provision of nutrition care services that shall include: 22 (a) Assessing nutrition needs and food patterns; EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD01613-01-7A. 75 2 1 (b) Planning for and directing the provision of food appropriate for 2 physical and nutrition needs; [and] 3 (c) Providing nutrition counseling[.]; and 4 (d) Using nutrition in healing. 5 § 2. Section 8002 of the education law, as added by chapter 635 of the 6 laws of 1991, is amended to read as follows: 7 § 8002. Use of titles. Only a person certified under this article 8 shall be authorized to use the title "certified dietitian", "certified 9 dietician", [or] "certified nutritionist", or "certified nutrition 10 specialist". 11 § 3. This act shall take effect immediately.
