        AN ACT to amend the education law, in relation to  aid  for  substantial
          enrollment growth and growth in enrollment of English language learner
          students

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 3602 of the education law is amended by adding  two
     2  new subdivisions 21 and 22 to read as follows:
     3    21.  Aid for substantial enrollment growth. For the two thousand twen-
     4  ty-three--two thousand twenty-four school  year,  each  school  district
     5  shall  be  apportioned  the greater of:  (a) the positive difference, if
     6  any, between the public school enrollment of the  district  in  the  two
     7  thousand  twenty-one--two  thousand  twenty-two school year, as computed
     8  pursuant to subparagraph two of paragraph n of subdivision one  of  this
     9  section,  and  such  enrollment in the two thousand twenty--two thousand
    10  twenty-one school year, subtracted by four-tenths of  one  percentum  of
    11  the two thousand twenty--two thousand twenty-one school year, multiplied
    12  by  the  selected  foundation aid per pupil; or (b) the positive differ-
    13  ence, if any, between the public school enrollment of  the  district  in
    14  the  two  thousand  eighteen--two  thousand  nineteen  school  year,  as
    15  computed pursuant to subparagraph two of paragraph n of subdivision  one
    16  of this section, and such enrollment in the two thousand twenty-one--two
    17  thousand  twenty-two  school year, divided by three, subtracted by four-
    18  tenths of one percentum of the two thousand eighteen--two thousand nine-
    19  teen school year, multiplied by the selected foundation aid per pupil.
    20    22. Aid for English language learner pupil growth. For the  two  thou-
    21  sand  twenty-three--two  thousand  twenty-four  school year, each school
    22  district shall be apportioned the greater of:  (a) the positive  differ-
    23  ence,  if  any,  between the English language learner pupil count of the

     1  district in the two thousand twenty-one--two thousand twenty-two  school
     2  year, and such count in the two thousand twenty--two thousand twenty-one
     3  school  year,  multiplied  by  two-tenths  and  multiplied  again by the
     4  selected  foundation  aid  per pupil; or (b) the positive difference, if
     5  any, between the public school enrollment of the  district  in  the  two
     6  thousand eighteen--two thousand nineteen school year, as computed pursu-
     7  ant  to  subparagraph  two  of  paragraph  n  of subdivision one of this
     8  section, and such enrollment in the two thousand  twenty-one--two  thou-
     9  sand  twenty-two school year, divided by three, multiplied by two-tenths
    10  and multiplied again by the selected foundation aid per pupil.
    11    § 2. This act shall take effect July 1, 2023.
