SYNOPSIS

     Overrides Governor's line-item veto reducing an appropriation and changing a related budget language provision for the AIDS Drug Distribution Program in the Department of Health and Senior Services.

A Concurrent Resolution overriding a line-item veto reducing an appropriation and changing a related budget language provision for the AIDS Drug Distribution Program in the Department of Health and Senior Services.

 

     Be It Resolved by the Senate of the State of New Jersey (the General Assembly concurring):

 

     1.  That the following appropriation on pages 82 and 83, and a related language provision on page 85, of Senate Bill No. 4000 of 2011 (P.L.2011, c.85) which were the subject of objections by the Governor in the Governor's veto statement of June 30, 2011, be restored to law as follows, the objections thereto of the Governor notwithstanding:

21 Health Services

GRANTS-IN-AID

 

12-4245 AIDS Services ........................................................... $7,000,000

Grants-in-Aid:

      12   AIDS Drug Distribution Program  ......  ($7,000,000)

 

Notwithstanding the provisions of any law or regulation to the contrary, the amount hereinabove appropriated for the AIDS Drug Distribution Program is conditioned upon the following: individuals whose income does not exceed 500% of the federal poverty level shall be eligible for coverage for all AIDS-related drugs and all other drugs.

 

     2.  BE IT FURTHER RESOLVED, that copies of this resolution be delivered to the Governor, the State Treasurer and Commissioner of the Department of Health and Senior Services.

 

 

STATEMENT

 

     This resolution overrides a line-item veto of an appropriation and a related budget language provision in the annual appropriations act for Fiscal Year 2012 that were eliminated by the Governor's line-item veto.  The Grants-In-Aid appropriation for the AIDS Drug Distribution Program in the Department of Health and Senior Services of $13,509,000 was reduced by $7,000,000 to $6,509,000 by the Governor's line-item veto.  The appropriation and the related language both were intended to expand eligibility of additional individuals and expand the full range of drugs available to treat AIDS related conditions.
