SYNOPSIS

     Approves NJ Building Authority project report concerning Security Command Center for the Public Health, Environmental and Agricultural Laboratories.

A Concurrent Resolution expressing the approval of the Legislature for a project report entitled "Acquisition and Renovation of a Facility to Serve as a Security Command Center for the Public Health, Environmental and Agricultural Laboratories," by the New Jersey Building Authority and expressing the sense of the Legislature that the project described in the report should be financed and managed by the authority.

 

Whereas, Pursuant to the "New Jersey Building Authority Act," P.L.1981, c.120 (C.52:18A-78.1 et seq.) (the "act"), the New Jersey Building Authority (the "authority") is authorized to undertake projects as defined in the act; and

Whereas, The authority has determined that it is desirable and in the best interests of the authority to undertake the project to acquire and renovate a facility to serve as a security command center for the Public Health, Environmental and Agricultural Laboratories ("NJPHEAL") to secure the NJPHEAL and the New Jersey State Police Division Headquarters Complex, which includes NJPHEAL, located in Ewing, New Jersey; and

Whereas, When proposing to undertake any project whose cost is estimated to exceed $100,000, the authority must comply with the provisions of the act by, among other things, preparing a project report, submitting the project report to the New Jersey Commission on Capital Budgeting and Planning for its review and findings, holding a public hearing in the municipality where the project is to be located, and submitting to the State Legislature the project report together with the findings of the Commission on Capital Budgeting and Planning, and a transcript of the public hearing; and

Whereas, On August 27, 2010, the authority adopted a resolution approving the project report referenced herein that describes the project it desires to undertake; and

Whereas, On October 22, 2010, the Commission on Capital Budgeting and Planning adopted resolution Number 12-1, approving the project report referenced herein that describes the project that the authority desires to undertake; and

Whereas, On October 28, 2010, the authority held a public hearing on the project it desires to undertake at the New Jersey State Police Museum & Learning Center, 1 River Road, Building 3, West Trenton, Ewing, New Jersey; and

Whereas, On January 5, 2011, pursuant to section 8 of the act, the authority submitted the project report and supporting documentation to the President of the Senate and the Speaker of the General Assembly; and

Whereas, The authority will fund this project by reallocating funds in the NJPHEAL project budget; and

Whereas, No additional authority indebtedness is contemplated and no additional State appropriation for debt service attributable to this project is required; and

Whereas, The act requires that a project to be undertaken by the authority be approved by the Legislature within 45 days of submission, or the next meeting date immediately thereafter for a house not meeting on that date, or else the project shall be deemed disapproved; and

Whereas, The project report proposes the following project:     Location - New Jersey Public Health, Environmental and Agricultural Laboratories located at the New Jersey State Police Division Headquarters Complex site, Ewing, New Jersey

     Description - Acquisition of an existing building, other site improvements, the directly adjacent parking lot, the remainder of the property and Trooper Drive, all of which are located at Block 423, Lot 10 in Ewing, New Jersey; renovation of the existing building to serve as the security command center; and improvements to Trooper Drive

     Current using agency - Department of Law and Public Safety    

     Projected costs - $4,140,000; and

Whereas, The project described in the authority project report referenced herein has a current total working estimated cost of $4,140,000 payable from NJPHEAL project funds to be reallocated for such purpose, but which could be as much as 10 to 15 percent higher depending on final design and contract bids and excluding funds from other sources; and

Whereas, The authority will fund the construction of the proposed project as described in the "Acquisition and Renovation of a Facility to Serve as a Security Command Center for the Public Health, Environmental and Agricultural Laboratories" project report through the use of authority NJPHEAL project funds to be reallocated for such purposes; now, therefore,

 

     Be It Resolved by the Senate of the State of New Jersey (the General Assembly concurring):

 

     1.    The Legislature hereby approves the New Jersey Building Authority's project report on the "Acquisition and Renovation of a Facility to Serve as a Security Command Center for the Public Health, Environmental and Agricultural Laboratories."  Approval of the report shall constitute approval of the project described therein for the purposes of subsection b. of section 8 of P.L.1981, c.120 (C.52:18A-78.8).  It is the sense of the Legislature that the New Jersey Building Authority project should be funded by authority project funds and managed directly by the authority, with delegation to other State agencies of managerial responsibility only where the authority deems it necessary, but with full control over project management retained by the authority.

 

     2.    Duly authenticated copies of this concurrent resolution, signed by the President of the Senate and attested by the Secretary thereof, and signed by the Speaker of the General Assembly and attested by the Clerk thereof, shall be transmitted to the New Jersey Building Authority.

 

 

STATEMENT

 

     This concurrent resolution approves the New Jersey Building Authority project report entitled "Acquisition and Renovation of a Facility to Serve as a Security Command Center for the Public Health, Environmental and Agricultural Laboratories."  The approval by the Legislature is required by the provisions of the "New Jersey Building Authority Act" before the authority can undertake a project.

     The resolution also expresses the sense of the Legislature that the authority should directly finance and manage its project, with delegation to other State agencies of managerial responsibility only where the authority deems it necessary, but with full control over project management retained by the authority.
