SYNOPSIS
Prohibits developer from diverting storm water runoff to adjacent or nearby private property.

An Act concerning storm water management and supplementing P.L.1975, c.291 (C.40:55D-1 et seq.).
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. No developer may construct a development in a manner that will cause or facilitate the runoff of storm water from the development onto adjacent or nearby private property owned by another person.
b. No municipal agency or State entity shall approve a storm water management plan for a development that includes a provision that plans for or allows, in an emergency or otherwise, storm water runoff from the development to be diverted onto adjacent or nearby private property owned by another person.
2. This act shall take effect on the 90th day after the date of enactment.
STATEMENT
This bill would prohibit a developer from constructing a development in a manner that will cause or facilitate the runoff of storm water from the development onto adjacent or nearby private property owned by another person.
The bill would also prohibit any municipal agency or State entity from approving a storm water management plan for a development that includes a provision that plans for or allows, in an emergency or otherwise, storm water runoff from the development to be diverted onto adjacent or nearby private property owned by another person.
