SYNOPSIS

     Concerns filling of office and duties of mayor under certain circumstances for municipality operating under small municipality plan of government.

An Act concerning the filling of the office and duties of mayor under certain circumstances for a municipality operating under the small municipality plan of government and amending P.L.1950, c.210.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 13-6 of P.L.1950, c.210 (C.40:69A-120) is amended to read as follows:

     The legislative power of the municipality shall be exercised by the council, except as may be otherwise provided by general law.  The mayor shall participate and vote as other council members.  A majority of the whole number of the governing body shall constitute a quorum for the transaction of business but a smaller number may meet and adjourn from time to time.  The mayor shall preside over all meetings of the council.  The council shall select from among its members a president of the council who shall [serve] preside over meetings of the council in place of the mayor in the event of [his] the mayor's absence, disability, or refusal to act.

     2.    Section 13-7 of P.L.1950, c.210 (C.40:69A-121) is amended to read as follows:

     The executive power of the municipality shall be exercised by the mayor.  It shall be [his] the duty of the mayor to see that all laws and ordinances in force and effect within the municipality are observed.  [He] The mayor shall address the council and report to the residents annually, and at such other times as [he] the mayor may deem desirable, on the condition of the municipality and upon its problems of government.  The mayor shall designate an officer of the municipality or a member of the council to act as mayor whenever the mayor shall be prevented by absence from the municipality, disability or other cause from attending to mayoral duties.  During such time, the person so designated by the mayor shall possess all the rights, powers, and duties of mayor, except as provided otherwise under section 13-6 of P.L.1950, c.210.

     3.    This act shall take effect 60 days after enactment. 

 

 

STATEMENT

 

     This bill authorizes the appointment of a mayor under certain
circumstances for municipalities that operate under the small municipality plan of government.

     The bill allows a mayor of a municipality governed by the "small municipality plan," of the "Optional Municipal Charter Law," P.L.1950, c.210 (C.40:69A-1 et. seq.) to appoint an officer of the municipality or a member of the council to serve in place of the mayor in the event that the mayor is temporarily unable to attend to the duties of the office of the mayor.  The person designated by the mayor to serve in place of the mayor would possess all the rights, powers, and duties of mayor.  The bill also amends a provision to allow the council to select a president of the council to preside over council meetings in place of the mayor under certain circumstances.  The bill would apply only to municipalities governed by the "small municipality plan" of the "Optional Municipal Charter Law," P.L.1950, c.210 (C.40:69A-1 et. seq.).
