     Requires school districts to inform DOE of number of students in certain out-of-State placements and number of students with individualized education programs identifying DHS or DCF for transition services.

An Act concerning students in out-of-State placements and supplementing chapter 46 of Title 18A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Beginning in the 2016-2017 school year, a school district shall notify the Department of Education no later than September 1 each year of the number of students residing in the district who were placed in the prior school year for the first time in an out-of-State private school for students with disabilities and the number of students in out-of-State private schools for students with disabilities whose individualized education program in the prior school year identified either the Department of Children and Families or the Department of Human Services as an agency required to provide transition services.

     b.    If the Department of Education receives information pursuant to subsection a. of this section that a student's individualized education program identifies the Department of Children and Families or the Department of Human Services, the Department of Education shall provide that information to the appropriate department.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill provides that beginning in the 2016-2017 school year, a school district will notify the Department of Education no later than September 1 each year of the number of students residing in the district who were placed in the prior school year for the first time in an out-of-State private school for students with disabilities.  The school district will also be required to inform the department of the number of students in out-of-State private schools for students with disabilities whose individualized education program (IEP) in the prior school year identified either the Department of Children and Families or the Department of Human Services as an agency required to provide transition services.  According to State Board of Education regulations, beginning with the IEP in place for the school year when a student will turn age 16, or younger if deemed appropriate by the IEP team, the IEP must include the transition services needed to assist the student in reaching his postsecondary goals.  Transition services consist of a coordinated set of activities for a student with a disability that is focused on improving the academic and functional achievement of the student to facilitate the student's movement from school to post-school activities.

     The bill also provides that if the Department of Education receives information that an IEP identifies the Department of Children and Families or the Department of Human Services as an agency required to provide transition services, the Department of Education is required to provide that information to the appropriate department.
