SYNOPSIS

     Requires ambulatory care facilities to provide patients with list of fees charged and itemized bill upon request, with opportunity to appeal charges.

An Act concerning ambulatory care facilities and supplementing Title 26 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    An ambulatory care facility licensed pursuant to P.L.1971, c.136 (C.26:2H-1 et seq.), including a facility licensed to perform surgical procedures, shall, upon request, provide a copy of the fees charged by the facility for health care services and procedures, an itemized bill, and an explanation of the charges to a patient or the patient's legal representative.  The payment rates, itemized bill, and explanation shall be provided regardless of the patient's source of payment.  The facility shall provide the patient or the patient's legal representative with the opportunity to appeal the charges.

 

     2.    The Commissioner of Health shall, pursuant to the "Administrative Procedure Act," P.L.1968, c.140 (C.52:14B-1 et seq.), promulgate such rules and regulations as may be necessary to effectuate the provisions of this act.

 

     3.    This act shall take effect the first day of the fourth month next following the date of enactment, except that the Commissioner of Health may take any advance administrative action as may be necessary to effectuate the provisions of this act.

 

 

STATEMENT

 

     This bill requires licensed ambulatory care facilities, including facilities licensed to perform surgical procedures, to provide, upon request, a copy of the fees charged by the facility for health care services and procedures, an itemized bill, and an explanation of the charges to a patient or the patient's legal representative.  The payment rates, itemized bill, and explanation are to be provided regardless of the patient's source of payment.  The facility is to additionally provide the patient or the patient's legal representative with the opportunity to appeal the charges.
