SYNOPSIS

     Requires Commissioner of Labor and Workforce Development to design and make available to public a webinar on TDI, family temporary disability leave, and family leave.

An Act concerning digital media information regarding temporary disability leave, family temporary disability leave, and family leave and supplementing chapter 1 of Title 34 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

1.         a.  The Commissioner of Labor and Workforce Development shall design and make available to the public on the department's website a webinar, or some other form of digital media as determined by the commissioner, that provides information on a covered employee's rights and obligations, including how a covered employee may apply for benefits and what documents are required for such an application, pursuant to the provisions of the "Temporary Disability Benefits Law," P.L.1948, c.110 (C.43:21-25 et al.), P.L.2008, c.17 (C.43:21-39.1 et al.), and the "Family Leave Act," P.L.1989, c.261 (C.34:11B-1 et seq.).  The webinar shall also include information on a covered employer's rights and obligations under each of these laws.  The commissioner shall publicize the availability of the webinar, or other form of digital media, to employers in the State and promote it as a tool for employers to provide employees with information regarding these laws.  The webinar, or other form of digital media, shall be designed and made public no later than one year after the effective date of this act, and shall be updated as needed to reflect current law.

     b. The webinar, or other form of digital media, designed and made available pursuant to subsection a. of this section may be used by employers to fulfill the employee notification requirements of section 25 of P.L.1948, c.110 (C.43:21-49), section 10 of P.L.2008, c.17 (C.43:21-39.1), and section 6 of P.L.1989, c. 261 (C:34:11B-6), provided that the webinar, or other form of digital media, is utilized in conjunction with the display or distribution of any other form of employee notification as required by law or regulations promulgated by the commissioner pursuant to law. 

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill requires the Commissioner of Labor and Workforce Development to design and make available to the public on the department's website a webinar, or some other form of digital media, that provides information on a covered employee's rights and obligations, including how a covered employee may apply for benefits and what documents are required for such an application, pursuant to the temporary disability insurance law, P.L.1948, c.110 (C.43:21-25 et al.); the family leave insurance law, P.L.2008, c.17 (C.43:21-39.1 et al.); and the "Family Leave Act," P.L.1989, c.261 (C.34:11B-1 et seq.).  The webinar is also required to include information on a covered employer's rights and obligations under each of these laws.

     Under the bill, the commissioner is required to publicize the availability of the webinar, or other form of digital media, to employers in the State and to promote it as a tool for employers to provide employees with information regarding these laws.  Furthermore, employers may use the webinar, or other form of digital media, to fulfill the employee notification requirements of these laws, provided that any other form of employee notification as required by law or regulation is also displayed or distributed.  Generally, a webinar is a web-based presentation, lecture, workshop, or seminar that is transmitted over the Internet.
