SYNOPSIS

     Requires Division of State Lottery to reduce advertising expenses for multi-state lottery games by sharing expenses with other participating states and to conduct evaluation of advertising expenses for State lottery games on annual basis.

An Act concerning the advertising by the Division of the State Lottery and amending P.L.1970, c.13.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 3 of P.L.1970, c.13 (C.5:9-3) is amended to read as follows:

     3.    For the purposes of this act:

     a.     "Commission" shall mean the State Lottery Commission established by this act.

     b.    "Division" shall mean the Division of the State Lottery created by this act.

     c.     "Lottery" or "State lottery" shall mean the lottery established and operated pursuant to this act.

     d.    "Director" shall mean the Director of the Division of the State Lottery.

     e.     "Multi-state lottery" shall mean any lottery in which more than one state participates, including Powerball and Mega Millions, or other comparable games.

     2.    Section 22 of P.L.1970, c.13 (C.5:9-22) is amended to read as follows:

     22.  a. The moneys in said State Lottery Fund shall be appropriated only (a) for the payment of prizes to the holders of winning lottery tickets or shares, (b) for the expenses of the division in its operation of the lottery, (c) for State institutions and State aid for education as shall be provided by law, and (d) for the repayment to the general treasury of the amount appropriated to the fund pursuant to section 23 of this act.  On or about March 15 and September 15 of each year, the State Treasurer shall publish in at least 10 newspapers circulating generally in the State a report accounting for the total revenues received in the State Lottery Fund and the specific amounts of money appropriated therefrom for specific expenditures during the preceding six months ending December 31 and June 30.

     b.    The division shall reduce operating expenses under subparagraph (b) of subsection a. of this section by evaluating the advertising and marketing expenses for multi-state lotteries and, when possible, sharing the advertising and marketing expenses for such lotteries with other participating states. 

     Beginning one year after the effective date of P.L.    , c.    (pending before the Legislature as this bill), the division shall on an annual basis evaluate its advertising and marketing expenses on all State lottery games to determine whether such advertising
and marketing continues to remain effective. and issue a report regarding its findings to the Governor, and to the Legislature, pursuant to section 2 of P.L.1991, c.164 (C.52:14-19.1).

     No later than 15 days after the submission of the report, the report shall be released by the State Treasurer to the public.

     3.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would require the Division of the State Lottery to evaluate on an annual basis the efficacy of the advertising and marketing of all State lottery games.  Further, this bill would require the division to work with other states participating in multi-state lottery games to share the expenses of advertising and marketing for those games.

     Under this bill, the division would have to provide to the Legislature and the Governor an annual report of its findings regarding the advertising and marketing of all State lottery games.

     The purpose of this bill is to reduce unnecessary operating expenses within the Division of the State Lottery so that more funds are available to the State for the benefit of the people of New Jersey.
