SYNOPSIS
Entitles member of Legislature, who also serves in another public or tax-supported position, unpaid time off from position to attend to legislative duties.

An Act concerning absence from public employment by a member of the Legislature, and amending N.J.S.18A:6-8.1 and P.L.1979, c.277.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. N.J.S.18A:6-8.1 is amended to read as follows:
18A:6-8.1. Any person employed by a public educational system or institution in a position which requires a certificate issued by the state board of examiners, or employed in a professional educational capacity by a school, college, or university which is either tax-supported or operated under contract with the state or on behalf of the state, who is a member of the senate or general assembly of the state of New Jersey, shall only be entitled to unpaid time off from his duties as such employee [, without loss of pay,] during the periods of his attendance at regular or special sessions of the legislature and hearings or meetings of any legislative committee or commission.

2. Section 1 of P.L.1979, c.277 (C.40A:9-7.2) is amended to read as follows:
1. Any person employed by any county, municipality, or agency thereof who is a member of the Senate or General Assembly of the State of New Jersey shall only be entitled to unpaid time off from his duties as such employee [, without loss of pay,] during the periods of his attendance at regular or special sessions of the Legislature and hearings or meetings of any legislative committee or commission.

3. This act shall take effect at noon on January 10, 2012.
STATEMENT
This bill entitles any member of Legislature, who also serves in another public position, unpaid time off from that other position to attend to legislative duties. This reverses currently law, providing such members time off without loss of pay during the periods of attending to legislative duties.
The bill specifically covers legislators who are employed in certain public or tax-supported educational settings, or employed or serve as an official, either elected or appointed, in county or municipal government. In the educational settings, the bill applies to legislators employed in a public educational system or institution, for which a certificate issued by the State Board of Examiners is required, or employed in a professional educational capacity by a school, college, or university which is either tax-supported or operated under contract with the State or on behalf of the State. For county or municipal government, the bill applies to legislators who are also county or municipal officers or employees.
The bill shall take effect at noon on January 10, 2012, being the second Tuesday of January of that year and representing the beginning of the new two-tear term of the Legislature in accordance with Article IV, Section I, paragraph 3 of the New Jersey Constitution.
