SYNOPSIS

     Appropriates $4,083,320 from "2009 Farmland Preservation Fund," "2007 Farmland Preservation Fund," and "Garden State Farmland Preservation Trust Fund" for grants to certain nonprofit organizations for farmland preservation purposes.

An Act concerning farmland preservation and appropriating monies from the "2009 Farmland Preservation Fund," the "2007 Farmland Preservation Fund," and the "Garden State Farmland Preservation Trust Fund" for grants to qualifying tax exempt nonprofit organizations for farmland preservation purposes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a. There is appropriated from the "2009 Farmland Preservation Fund," established pursuant to section 18 of the "Green Acres, Water Supply and Floodplain Protection, and Farmland and Historic Preservation Bond Act of 2009," P.L.2009, c.117, from the "2007 Farmland Preservation Fund," established pursuant to section 18 of the "Green Acres, Farmland, Blue Acres, and Historic Preservation Bond Act of 2007," P.L.2007, c.119, and from the "Garden State Farmland Preservation Trust Fund," established pursuant to section 20 of P.L.1999, c.152 (C.13:8C-20), to the State Agriculture Development Committee the following sums for the purpose of providing grants to qualifying tax exempt nonprofit organizations listed in subsection b. of this section for up to 50% of the cost of acquisition of development easements on farmland or for up to 50% of the cost of acquisition of fee simple titles to farmland for resale or lease with agricultural deed restrictions approved by the committee:

     (1)   $1,527,298 from the "2009 Farmland Preservation Fund";

     (2)   $1,446,133 from the "2007 Farmland Preservation Fund," made available due to project withdrawals, canceled obligations, and reallocation of monies previously appropriated pursuant to P.L.2009, c.95; and

     (3)   $1,109,889 from the "Garden State Farmland Preservation Trust Fund," made available due to project withdrawals, cancelled obligations, and reallocation of monies previously appropriated pursuant to P.L.1999, c.138, P.L.2003, c.82, P.L.2003, c.244, P.L.2005, c.180, P.L.2006, c.81, and P.L.2007, c.186.

     b.    The following projects are eligible for funding with the monies appropriated pursuant to subsection a. of this section:

     2.    a.  Of the monies appropriated pursuant to P.L.2009, c.95, from the "2007 Farmland Preservation Fund," established pursuant to section 18 of the "Green Acres, Farmland, Blue Acres, and Historic Preservation Bond Act of 2007," P.L.2007, c.119, the sum of $1,446,133 is made available due to project withdrawals, cancelled obligations, and reallocation of previously appropriated funds.

     b.    Of the monies appropriated or reappropriated pursuant to P.L.1999, c.138, P.L.2003, c.82, P.L.2003, c.244, P.L.2005, c.180, P.L.2006, c.81, and P.L.2007, c.186, from the "Garden State Farmland Preservation Trust Fund," established pursuant to section 20 of the "Garden State Preservation Trust Act," P.L.1999, c.152 (C.13:8C-20), the sum of $1,109,889 is made available due to project withdrawals, cancelled obligations, and reallocation of previously appropriated funds.

     3.    The expenditure of the sums appropriated by this act is subject to the provisions and conditions of P.L.2009, c.117, P.L.2007, c.119, P.L.1999, c.152 (C.13:8C-1 et seq.), and P.L.1983, c.32 (C.4:1C-11 et seq.), as appropriate.

 

     4.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would appropriate a total of $4,083,320 to the State Agriculture Development Committee (SADC) for farmland preservation purposes, as follows:

     (1)   $1,527,298 from the "2009 Farmland Preservation Fund";

     (2)   $1,446,133 from the "2007 Farmland Preservation Fund," made available due to project withdrawals, cancelled obligations and reallocation of monies previously appropriated pursuant to P.L.2009, c.95; and

     (3)   $1,109,889 from the "Garden State Farmland Preservation Trust Fund," made available due to project withdrawals, cancelled obligations and reallocation of monies previously appropriated pursuant to P.L.1999, c.138, P.L.2003, c.82, P.L.2003, c.244, P.L.2005, c.180, P.L.2006, c.81, and P.L.2007, c.186.

     The "Garden State Farmland Preservation Trust Fund" was established pursuant to section 20 of the "Garden State Preservation Trust Act," P.L.1999, c.152 (C.13:8C-20).

     Specifically, the bill would appropriate these sums for grants to qualifying tax exempt nonprofit organizations for (1) up to 50% of the cost of acquisition of development easements on farmland for farmland preservation purposes, or (2) up to 50% of the cost of acquisition of fee simple titles to farmland for resale or lease with agricultural deed restrictions approved by the SADC.

     The allocations and projects listed in this bill have been approved by the SADC and the Garden State Preservation Trust.

     Lastly, this bill would cancel certain prior appropriations totaling $2,556,022 for farmland preservation projects which have been made available due to project withdrawals, canceled obligations, and reallocation of previously appropriated funds, thereby making those monies available for appropriation again to fund other farmland preservation projects.
