A Supplement to "An Act making appropriations for the support of the State Government and the several public purposes for the fiscal year ending June 30, 2012 and regulating the disbursement thereof," approved June 30, 2011 (P.L.2011, c.85).

 

     Be It Enacted by the Senate and the General Assembly of the State of New Jersey:

 

     1.    In addition to the amounts appropriated under P.L.2011, c.85, there is appropriated out of the General Fund the following sum for the purpose specified:

26 Senior Services

GRANTS-IN-AID

     2.    Upon certification by the Director of the Division of Budget and Accounting in the Department of the Treasury that federal funds to support the expenditures listed below are available, the following sum is appropriated:

     3.    This act shall take effect immediately and shall be retroactive to July 1, 2011.

 

 

STATEMENT

 

     This supplemental appropriation provides $38 million of State and federal funding for nursing homes.  This supplemental appropriation, along with the current appropriation, is intended to fully fund these facilities according to the new reimbursement rate formula adopted in March 2011.

     The FY2012 annual appropriations act reduces the funding for nursing homes as follows: 1) a three percent reduction in the amount available to support nursing homes; and 2) per-diem reimbursement rates for nursing homes developed according to the new rate-setting methodology codified under N.J.A.C.8:85-3.1 et seq.  This methodology provides that during FY2012 a nursing home's per diem rate cannot vary more than ten dollars from the per diem reimbursement rate received by that facility in FY2010, but otherwise sets reimbursement rates based on a facility's case mix rather than the size of its patient population.

     With the changes in the nursing home funding formula, the current appropriation fails to fully fund some facilities as prescribed by the funding formula.  This supplemental appropriation provides $38 million in additional funding to offset part of the reduction recommended in the Governor's recommended budget and adopted by the FY2012 appropriations act.
