An Act concerning certain court proceedings and supplementing Title 2B of the New Jersey Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. In the discretion of the court, upon application of the prosecutor, any criminal trial, hearing of a motion or other application, pretrial conference, arraignment, sentencing conference or appeal may be closed to the public, and all records sealed, for compelling reasons involving interests of national or State security.
2. This act shall take effect immediately.
STATEMENT
This bill clarifies the authority of the court to close proceedings to the public in cases involving national or State security. Under the bill, upon application of the prosecutor, any trial, hearing of a motion or other application, pretrial conference, arraignment, sentencing conference or appeal may be closed to the public, and all records sealed, for compelling reasons involving interests of national or State security.
