An Act prohibiting the New Jersey Motor Vehicle Commission from charging certain fees for registration renewals and supplementing chapter 7 of Title 12 and chapter 3 of Title 39 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  The New Jersey Motor Vehicle Commission is prohibited from charging a convenience fee in connection with the renewal of a vessel certificate of number issued pursuant to the provisions of the "New Jersey Boat Act of 1962," P.L.1962, c.73 (C.12:7-34.36 et seq.).

     For the purposes of this section, "convenience fee" means an amount charged in connection with a renewal of a vessel certificate of number that is in addition to the amount prescribed as the fee for all such renewals under subsection (a) of section 12 of P.L.1962, c.73 (C.12:7-34.37) and imposed to offset processing charges or any other costs associated with the acceptance of a credit or debit card or any other payment device, or for any other purpose, except as specifically provided by law.

 

     2.  The New Jersey Motor Vehicle Commission is prohibited from charging a convenience fee in connection with the renewal of a motor vehicle registration issued pursuant to the provisions of chapter 3 of Title 39 of the Revised Statutes.

     For the purposes of this section, "convenience fee" means an amount charged in connection with a renewal of motor vehicle registration that is in addition to the amount prescribed as the fee for all such renewals under chapter 3 of Title 39 of the Revised Statutes and imposed to offset processing charges or any other costs associated with the acceptance of a credit or debit card or any other payment device, or for any other purpose, except as specifically provided by law.

 

     3.  This act shall take effect on the first day of the fourth month next following the date of enactment.

 

 

STATEMENT

 

     This bill would prohibit the New Jersey Motor Vehicle Commission (MVC) from charging customers a convenience fee for the renewal of a motor vehicle or boat registration.  As defined in the bill, a convenience fee is an amount charged in addition to the prescribed registration renewal fee and which is imposed to offset processing charges or any other costs associated with the acceptance of a credit or debit card or any other payment device, or for any other purpose.  However, the bill would not prohibit the MVC from imposing and collecting additional fees which are specifically provided by law.  Currently, the MVC charges customers a $2 convenience fee when they renew their boat or motor vehicle registrations through the MVC's online registration renewal system.
