     Repeals increased penalties for violations in 65 mph zone.

An Act concerning motor vehicles and repealing section 5 of P.L.1997, c. 415.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  Section 5 of P.L.1997, c. 415 (C.39:4-98.6) is repealed. 

 

     2.  This act shall take effect immediately. 

 

 

STATEMENT

 

     This bill would repeal section 5 of P.L.1997, c. 415 (C. 39:4-98.6), which specifies that the fines for certain motor vehicle offenses are doubled when those offenses are committed in a 65 mile per hour zone.  Under current law the fine for the following offenses is doubled when a driver is operating a motor vehicle in a 65 mile per hour zone:

·        R.S.39:4-52 Racing on highway;

·        R.S.39:4-57, 39:4-57 Failure to observe of directions of officers;

·        R.S.39:4-80 Failure to comply with traffic control by officers;

·        R.S.39:4-81 Failure to observe traffic signals;

·        R.S.39:4-84 Failure to pass to right of vehicle proceeding in opposite direction;

·        R.S.39:4-85 Improper passing on right or off roadway;

·        R.S.39:4-86 Improper passing in no passing zone;

·        R.S.39:4-88 Failure to observe traffic lanes;

·        R.S.39:4-89  Tailgating;

·        R.S.39:4-90 Failure to yield at intersection;

·        R.S.39:4-96 Reckless driving;

·        R.S.39:4-97 Careless driving;

·        R.S.39:4-98 Exceeding the speed limit when guilty of driving at a speed that is 10 miles per hour or more over the established speed limit;

·        R.S.39:4-126 Failure to give proper signal;

·        R.S.39:4-127 Improper backing or turning in street;

·        R.S.39:4-129 Leaving the scene of an accident; 

·        R.S.39:4-144   Failure to observe stop or yield signs;

·        P.L.1955, c.217 (C.39:5C-1) Racing on highway;

·        Section 41 of P.L.1951, c.23 (C.39:4-82.1) Improper operating of vehicle on divided highway or divider;

·        Section 51 of P.L.1951, c.23 (C.39:4-90.1) Failure to use proper entrances to limited access highways; and

·        Section 5 of P.L.1951, c.264 (C.27:23-29) Moving against traffic.
