AN ACT relative to the cost estimate or fiscal note requirement for legislation proposing a study.

ANALYSIS

 

This bill requires that legislation proposing a study limited to general court members only to include a cost estimate of mileage.  The bill also requires other legislation proposing a study and which includes state or political subdivision members to have a fiscal note prepared by the legislative budget assistant.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty

 

AN ACT relative to the cost estimate or fiscal note requirement for legislation proposing a study.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Legislation; Bills Establishing Studies.  Cost Estimates; Fiscal Notes.  Amend RSA 14 by inserting after section 49 the following new section:

14:49-a  Legislation Establishing Studies; Cost Estimates; Fiscal Notes.

I.  Any member of the house of representatives or senate proposing the introduction of legislation which includes a legislative study committee, as defined in RSA 14:49, and which is limited to the members of the general court, shall include an estimate of the cost as follows:

(a)  The proposed number of members of the general court;

(b)  The estimated number of meetings for the study; and

(c)  The resulting estimate for mileage reimbursement to the legislators using the average daily mileage reimbursement as calculated by the general court administrative office.  

II.  Legislation proposed by any member of the house of representatives or senate which includes a study consisting of members of the general court and/or members from a state department, board, institution, commission, agency, or political subdivision, or which requires operational support or staffing from a state agency, and which is codified in the RSAs, shall comply with the requirements under RSA 14:44 - RSA 14:46 for the preparation of fiscal notes.  The member proposing the legislation for introduction to the general court shall also include an estimate of the cost for mileage as described in subparagraph I(a)-(c).

2  Fiscal Notes Exception Limited.  Amend RSA 14:44, III(c) to read as follows:

(c)  Establish study committees as described in RSA 14:49-a, I, where the only fiscal impact of the bill is due to legislative mileage authorized for legislative members.

3  Effective Date.  This act shall take effect 60 days after its passage.
